                                     AN ACT

     1  Amending the act of August 15, 1961 (P.L.987, No.442), entitled
     2     "An act relating to public works contracts; providing for
     3     prevailing wages; imposing duties upon the Secretary of Labor
     4     and Industry; providing remedies, penalties and repealing
     5     existing laws," prohibiting certain forms of retaliatory
     6     action by employers; and providing for a civil remedy.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 11 of the act of August 15, 1961
    10  (P.L.987, No.442), known as the Pennsylvania Prevailing Wage
    11  Act, is amended by adding a subsection to read:
    12     Section 11.  Remedies and Penalties.--* * *
    13     (i)  No employer may discharge, threaten or otherwise
    14  discriminate against an employe because the employe has filed a
    15  complaint under this act or has testified in support of a
    16  complaint filed under this act. An employe who suffers a loss as
    17  a result of a violation of this subsection shall have the right
    18  to recover compensatory damages in a civil action filed in the
    19  court of common pleas.

     1     Section 2.  This act shall apply to complaints filed on or
     2  after the effective date of this act.
     3     Section 3.  This act shall take effect immediately.
