        SENATOR CONTI, GAME AND FISHERIES, IN SENATE, AS AMENDED,
           JUNE 7, 2005

                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, providing for license fee for deployed Pennsylvania
     3     National Guard members.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 30 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2707.1.  Deployed Pennsylvania National Guard members.
     9     (a)  Eligibility.--The commission or a county treasurer shall
    10  issue one annual resident fishing license at a cost of $1 to a    <--
    11  member of the Pennsylvania National Guard when:
    12         (1)  The member is eligible for a resident fishing


     1     license under section 2701 (relating to resident fishing
     2     licenses).
     3         (2)  The member has served on active Federal service and
     4     was deployed overseas for a period of 180 consecutive days or
     5     more, including a member released early from such service
     6     because of an injury or disease incurred in the line of duty.
     7         (3)  The member presents documentation showing the dates
     8     of active Federal service and deployment.
     9     (b)  Time.--A member eligible for a resident fishing license
    10  under this section may apply for and receive one such license
    11  for any license year beginning on the date of the member's
    12  release from active Federal service and ending 24 months
    13  thereafter.
    14     (c)  Limitation.--A member eligible for a resident fishing
    15  license under this section shall be issued only one such annual
    16  license per qualifying deployment. ANY PERSON ELIGIBLE UNDER      <--
    17  SECTION 2701 (RELATING TO RESIDENT FISHING LICENSES) FOR THE
    18  LICENSE WHO PROVIDES DOCUMENTATION THAT WITHIN THE PREVIOUS 24
    19  MONTHS THE PERSON WAS DEPLOYED OVERSEAS AS A MEMBER OF THE
    20  PENNSYLVANIA ARMY NATIONAL GUARD OR AIR NATIONAL GUARD ON ACTIVE
    21  FEDERAL SERVICE FOR A PERIOD OF 180 CONSECUTIVE DAYS OR MORE OR
    22  WAS RELEASED EARLY FROM SUCH SERVICE BECAUSE OF AN INJURY OR
    23  DISEASE INCURRED IN THE LINE OF DUTY. ONLY ONE PENNSYLVANIA
    24  NATIONAL GUARD FISHING LICENSE UNDER THIS SECTION MAY BE ISSUED
    25  FOR EACH QUALIFYING DEPLOYMENT OF A PERSON APPLYING FOR THE
    26  LICENSE.
    27     (d) (B)  Regulations.--The commission may promulgate           <--
    28  regulations to implement this section.
    29     Section 2.  This act shall take effect in 60 days.             <--
