        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           MAY 3, 2005

                                     AN ACT

     1  Amending Title 30 (Fish) of the Pennsylvania Consolidated
     2     Statutes, providing for license fee exemption for deployed     <--
     3     Pennsylvania National Guard members.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 30 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 2707.1.  Deployed Pennsylvania National Guard members.
     9     (a)  Eligibility.--The commission or a county treasurer shall
    10  issue one annual resident fishing license at a cost of $1 to a
    11  member of the Pennsylvania National Guard when:
    12         (1)  The member is eligible for a resident fishing
    13     license under section 2701 (relating to resident fishing

     1     licenses).
     2         (2)  The member has served on active Federal service and
     3     was deployed overseas for a period of 180 consecutive days or
     4     more, including a member released early from such service
     5     because of an injury or disease incurred in the line of duty.
     6         (3)  The member presents documentation showing the dates
     7     of active Federal service and deployment.
     8     (b)  Time.--A member eligible for a resident fishing license
     9  under this section may apply for and receive one such license
    10  for any license year beginning on the date of the member's
    11  release from active Federal service and ending 24 months
    12  thereafter.
    13     (c)  Limitation.--A member eligible for a resident fishing
    14  license under this section shall be issued only one such annual
    15  license per qualifying deployment.
    16     (d)  Regulations.--The commission may promulgate regulations
    17  to implement this section.
    18     Section 2.  This act shall take effect in 60 days.
