AN ACT 1 Authorizing the Governor to award a distinguished military 2 service medal; and making an appropriation. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. Short title. 6 This act shall be known and may be cited as the Distinguished 7 Military Service Medal Act. 8 Section 2. Medal eligibility. 9 (a) Criteria.--The Governor may present in the name of the 10 Commonwealth of Pennsylvania a distinguished military service 11 medal of appropriate design and ribbon to be worn in lieu 12 thereof to:
1 (1) any resident of this Commonwealth who was a resident 2 of this Commonwealth at the time of entry into active 3 military service and: 4 (i) who, while serving in the Federal military or in 5 an organized militia on active duty in time of war or 6 emergency, shall have been distinguished by especially 7 meritorious service and who has been or may be cited in 8 orders for distinguished service by the Governor or by an 9 appropriate Federal authority; or 10 (ii) who shall have seen active military service in 11 the armed forces of the United States in a combat theater 12 of operations during time of war or emergency as attested 13 to by the awarding of an honorable discharge and DD 214 14 or WD 53 by the respective armed force; 15 (2) any deceased person who, on the date of induction 16 into the Federal military or organized militia service, was a 17 resident of this Commonwealth; and 18 (i) who, while serving in the Federal military 19 service or in the organized militia on active duty in 20 time of war or emergency, shall have been distinguished 21 by especially meritorious service and who has been or may 22 be cited in orders for distinguished service by the 23 Governor or an appropriate Federal authority; or 24 (ii) who shall have seen active military service in 25 the armed forces of the United States in a combat theater 26 of operations during time of war or emergency as attested 27 to by the awarding of an honorable discharge and DD 214 28 or WD 53 by the respective armed force; or 29 (3) any person who, on the date of induction into the 30 Federal military service or the organized militia was a 20050H0943B1064 - 2 -
1 resident of this Commonwealth who, while serving in the 2 Federal military service or the organized militia on active 3 duty in time of war or emergency, shall have been officially 4 listed as a prisoner of war or missing in action by the 5 Department of Defense. 6 (b) Special presentation.--The service medal for a deceased 7 person or a person absent as a prisoner of war or missing in 8 action shall be issued to the parent, spouse, sibling or other 9 relative who submits all of the required forms and documentation 10 on behalf of that person. 11 Section 3. Regulations. 12 The Department of Military and Veterans Affairs shall develop 13 any necessary regulations needed for the implementation of this 14 act. 15 Section 4. Appropriation. 16 The sum of $4,000,000, or as much thereof as may be 17 necessary, is hereby appropriated to the Department of Military 18 and Veterans Affairs in order to carry out the provisions of 19 this act. 20 Section 5.
