           ROHRER, RUBLEY, SAYLOR, E. Z. TAYLOR, YOUNGBLOOD, CLYMER,
           LEACH, BOYD AND B. SMITH, MARCH 14, 2005

        AS REPORTED FROM COMMITTEE ON LABOR RELATIONS, HOUSE OF
           REPRESENTATIVES, AS AMENDED, OCTOBER 31, 2005

                                     AN ACT

     1  Amending the act of December 5, 1936 (2nd Sp.Sess., 1937
     2     P.L.2897, No.1), entitled "An act establishing a system of
     3     unemployment compensation to be administered by the
     4     Department of Labor and Industry and its existing and newly
     5     created agencies with personnel (with certain exceptions)
     6     selected on a civil service basis; requiring employers to
     7     keep records and make reports, and certain employers to pay
     8     contributions based on payrolls to provide moneys for the
     9     payment of compensation to certain unemployed persons;
    10     providing procedure and administrative details for the
    11     determination, payment and collection of such contributions
    12     and the payment of such compensation; providing for
    13     cooperation with the Federal Government and its agencies;
    14     creating certain special funds in the custody of the State
    15     Treasurer; and prescribing penalties," providing for a study
    16     to make recommendations for redesigning the contribution rate
    17     notice form and related documents.

    18     The General Assembly of the Commonwealth of Pennsylvania
    19  hereby enacts as follows:
    20     Section 1.  Section 204.1 of the act of December 5, 1936 (2nd
    21  Sp.Sess., 1937 P.L.2897, No.1), known as the Unemployment
    22  Compensation Law, is amended by adding a subsection to read:
    23     Section 204.1.  State Unemployment Compensation Advisory
    24  Council.--* * *

     1     (l)  (1)  (i)  The council shall conduct a study and make
     2  recommendations to the department regarding redesigning the
     3  contribution rate notice form and other related documents
     4  provided to employers.
     5     (ii)  The council shall solicit input from State and local
     6  business leaders representing a variety of industries, including
     7  those employing fewer than ten employes.
     8     (iii)  The council shall also review notice and form formats
     9  utilized in other states.
    10     (2)  (i)  No later than January 1, 2005 2007, the council      <--
    11  shall make recommendations to the department regarding
    12  improvements that should be made to the design of the
    13  contribution rate notice and other related documents.
    14     (ii)  A copy of the recommendations shall be submitted to the
    15  President pro tempore of the Senate and to the Speaker of the
    16  House of Representatives.
    17     (3)  Within six months of receipt of the council's
    18  recommendations regarding the design of the contribution rate
    19  notice form and other related documents, the department shall
    20  implement revised forms based on the recommendations of the
    21  council.
    22     Section 2.  This act shall take effect in 60 days.
