                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, defining the offense of deception
     3     relating to public or private grants or programs; and
     4     imposing a penalty.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 18 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 4107.3.  Deception relating to public or private grants or
    10             programs.
    11     (a)  Offense defined.--No person, over the telephone or by
    12  electronic means, may request or accept a payment from a bank or
    13  credit union checking or savings account for an offer or implied
    14  offer to assist the consumer in qualifying for, researching or
    15  providing information about public or private grants or
    16  programs.
    17     (b)  Exceptions.--This section shall not apply to:


     1         (1)  any Federal, State or local government agency or its
     2     authorized agent in the performance of official governmental
     3     duties; or
     4         (2)  any services offered to any government agency by any
     5     business or nonprofit organization registered with the
     6     Department of State.
     7     (c)  Penalty.--A person who violates this section commits a
     8  misdemeanor of the first degree and shall, upon conviction, be
     9  sentenced to pay a fine of $10,000.
    10     Section 2.  This act shall take effect in 60 days.
