                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further defining compulsory school
     6     age.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 1326 of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949, is
    11  amended to read:
    12     Section 1326.  Definitions.--The term "compulsory school
    13  age," as hereinafter used, shall mean the period of a child's
    14  life from the time the child's parents elect to have the child
    15  enter school, which shall be not later than at the age of eight
    16  (8) years, until the age of [seventeen (17)] eighteen (18)
    17  years. The term shall not include any child who holds a
    18  certificate of graduation from a regularly accredited senior


     1  high school[.] or any child participating in a home education
     2  program who demonstrates to the superintendent of the school
     3  district completion of graduation requirements by a notarized
     4  affidavit or produces a statement from a person qualified under
     5  section 1327.1(e)(1)(ii) to evaluate home education programs
     6  indicating that graduation requirements have been completed in
     7  accordance with sections 1327 and 1327.1.
     8     The term "migratory child," wherever used in this subdivision
     9  of this article, shall include any child domiciled temporarily
    10  in any school district for the purpose of seasonal employment,
    11  but not acquiring residence therein, and any child accompanying
    12  his parent or guardian who is so domiciled.
    13     Section 2.  This act shall take effect July 1, 2005, or
    14  immediately, whichever is later.
