        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           DECEMBER 5, 2005

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for the offense of    <--
     3     THE OFFENSES OF POSSESSING INSTRUMENTS OF CRIME AND OF         <--
     4     scattering rubbish.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Section 6501(b)(1) of Title 18 of the              <--
     8  Pennsylvania Consolidated Statutes is amended to read:
     9     SECTION 1.  SECTIONS 907(B) AND 6501(B)(1) OF TITLE 18 OF THE  <--
    10  PENNSYLVANIA CONSOLIDATED STATUTES ARE AMENDED TO READ:
    11  § 907.  POSSESSING INSTRUMENTS OF CRIME.

    13     (B)  POSSESSION OF WEAPON.--A PERSON COMMITS A [MISDEMEANOR
    14  OF THE FIRST] FELONY OF THE THIRD DEGREE IF HE POSSESSES A
    15  FIREARM OR OTHER WEAPON CONCEALED UPON HIS PERSON WITH INTENT TO
    16  EMPLOY IT CRIMINALLY.

     2  § 6501.  Scattering rubbish.

     4     (b)  Penalty.--
     5         (1)  A person who violates subsection (a)(1) or (2) is
     6     guilty of a summary offense for the first offense and upon
     7     conviction thereof shall be sentenced to:
     8             (i)  pay a fine of not less than [$50] $250 nor more
     9         than [$300] $500 [or to];
    10             (ii)  imprisonment for not more than 90 days[, or
    11         both.];
    12             (iii)  not more than 90 days of community service; or
    13             (iv)  any combination of subparagraphs (i), (ii) and
    14         (iii).

    16     Section 2.  This act shall take effect in 60 days.
