           MARCH 22, 2006

                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, further providing for period of disqualification,
     3     revocation or suspension of operating privilege and for
     4     chemical testing to determine amount of alcohol or controlled
     5     substance.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1541(a.1) of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended to read:
    10  § 1541.  Period of disqualification, revocation or suspension of
    11             operating privilege.

    13     (a.1)  Credit toward serving period of suspension for certain
    14  violations.--Credit toward serving the period of suspension or
    15  revocation imposed for sections 1543(b)(1.1) (relating to


     1  driving while operating privilege is suspended or revoked), 3732
     2  (relating to homicide by vehicle), 3735 (relating to homicide by
     3  vehicle while driving under [the] influence), 3735.1 (relating
     4  to aggravated assault by vehicle while driving under the
     5  influence), 3742 (relating to accidents involving death or
     6  personal injury), 3802 (relating to driving under influence of
     7  alcohol or controlled substance) and 3808(a)(2) (relating to
     8  illegally operating a motor vehicle not equipped with ignition
     9  interlock) shall not commence until the date of the person's
    10  release from prison.

    12     Section 2.  Section 1547 of Title 75 is amended by adding a
    13  subsection to read:
    14  § 1547.  Chemical testing to determine amount of alcohol or
    15             controlled substance.
    16     * * *
    17     (g.1)  Cost of testing.--The cost of chemical testing,
    18  including the drawing of blood and urine, performed under this
    19  section shall be paid as follows:
    20         (1)  By the individual tested, if the individual was
    21     convicted under section 3802.
    22         (2)  By the requesting authority, if the test shows the    <--
    23     individual was not convicted under section 3802. INDIVIDUAL    <--
    24     WAS FOUND NOT GUILTY UNDER SECTION 3802 OR HAD THE CHARGES
    25     DISMISSED BECAUSE THE INDIVIDUAL WAS NOT GUILTY OF A
    26     VIOLATION OF SECTION 3802.

    28     Section 3.  This act shall take effect in 60 days.
