AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, defining "biometrics," "fingerprint imaging" and 3 "smart card technology"; and further providing for issuance 4 and content of driver's license and for commercial driver's 5 license. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Section 102 of Title 75 of the Pennsylvania 9 Consolidated Statutes is amended by adding definitions to read: 10 § 102. Definitions. 11 Subject to additional definitions contained in subsequent 12 provisions of this title which are applicable to specific 13 provisions of this title, the following words and phrases when 14 used in this title shall have, unless the context clearly 15 indicates otherwise, the meanings given to them in this section: 16 * * * 17 "Biometrics." The science and technology for measuring and 18 analyzing human body characteristics, including, but not limited
1 to, fingerprints, eye retinas and irises, voice patterns, facial 2 patterns or hand measurements for the purpose of personal 3 identity authentication. 4 * * * 5 "Fingerprint imaging." A biometric process by which 6 fingerprints are scanned, identifying features (minutiae) are 7 extracted and measurements of the minutiae points relative to 8 each other are mapped for comparison. 9 * * * 10 "Smart card technology." A small electronic device that 11 contains electronic memory on an embedded integrated circuit. 12 * * * 13 Section 2. Section 1510(a) and (b) of Title 75, amended 14 November 30, 2004 (P.L.1474, No.188), are amended and the 15 section is amended by adding subsections to read: 16 § 1510. Issuance and content of driver's license. 17 (a) General rule.--The department shall, upon payment of the 18 required fee, issue to every qualified applicant a driver's 19 license [indicating the type or general class of vehicles the 20 licensee is authorized to drive and any endorsements or 21 restrictions, which license shall contain a distinguishing 22 number assigned by the department to the licensee, the actual 23 name, date of birth, residence address, a color photograph or 24 photographic facsimile of the licensee, such other information 25 as may be required by the department, and either a facsimile of 26 the signature of the licensee or a space upon which the licensee 27 shall write his usual signature with pen and ink.] which 28 complies with the requirements of subsections (a.1), (a.2) and 29 this subsection. The driver's license shall be designed and 30 manufactured utilizing smart card technology which utilizes a 20050H0510B0548 - 2 -
1 departmental managed smart card technology database to retrieve 2 the pertinent information under subsections (a.1) and (a.2). 3 Program participants in the Address Confidentiality Program 4 under 23 Pa.C.S. Ch. 67 (relating to domestic and sexual 5 violence victim address confidentiality) may use a substitute 6 address designated by the Office of Victim Advocate as their 7 address. Personal medical data and other information for use in 8 an emergency may be included as a part of the license. 9 Information other than that required to identify the licensee, 10 the distinguishing number and the class of license issued may be 11 included in microdata form. Except as provided in subsection 12 (f), an applicant shall include his Social Security number on 13 his license application, but the Social Security number shall 14 not be included on the license. No driver's license shall be 15 valid until it has been signed by the licensee. 16 (a.1) Visual information on license.--A driver's license 17 issued under subsection (a) shall contain in visual format all 18 of the following: 19 (1) A distinguishing number assigned by the department 20 to the licensee. 21 (2) A color photograph or photographic facsimile of the 22 licensee. 23 (3) The actual name of the licensee in printed form. 24 (4) A facsimile of the signature of the licensee. 25 (5) The expiration date of the license. 26 (6) Any other information the department deems 27 necessary. 28 (a.2) Information stored by smart card technology.--The 29 smart card technology required under this section shall be 30 capable of storing in a secure manner all of the following 20050H0510B0548 - 3 -
1 information: 2 (1) A distinguishing number assigned by the department 3 to the licensee. 4 (2) The actual name of the licensee. 5 (3) The date of birth of the licensee. 6 (4) The residential address of the licensee. 7 (5) A physical description of the person, including sex, 8 height and eye color. 9 (6) A facsimile of the signature of the licensee. 10 (7) Social Security number. 11 (8) Fingerprint image. 12 (9) The type or general class of vehicles the licensee 13 is authorized to drive. 14 (10) Any restrictions or endorsements. 15 (11) The expiration date of the license. 16 (12) Any other information the department deems 17 necessary. 18 (b) Identification card.--The department shall, upon payment 19 of the required fee, issue an identification card to any person 20 who has made application therefor in such manner as the 21 department shall prescribe or whose driver's license has been 22 surrendered to the department because of a suspension or 23 revocation of an operating privilege under this or any other 24 title. Program participants in the Address Confidentiality 25 Program under 23 Pa.C.S. Ch. 67 may use a substitute address 26 designated by the Office of Victim Advocate as their address. 27 The identification card shall be designed and manufactured in 28 the same manner and of the same components as a driver's license 29 and shall have substantially the same content as a driver's 30 license but shall clearly indicate that it is not a driver's 20050H0510B0548 - 4 -
1 license. Upon failure of any person to pass any examination 2 required under section 1514 (relating to expiration and renewal 3 of drivers' licenses), the department shall, where appropriate, 4 issue a complimentary identification card as an expression of 5 gratitude for years of safe driving. The card shall only be 6 issued upon receipt of the person's driver's license. have 7 substantially the same content as a driver's license but shall 8 clearly indicate that it is not a driver's license. Upon failure 9 of any person to pass any examination required under section 10 1514 (relating to expiration and renewal of drivers' licenses), 11 the department shall, where appropriate, issue a complimentary 12 identification card as an expression of gratitude for years of 13 safe driving. The card shall only be issued upon receipt of the 14 person's driver's license. 15 * * * 16 Section 3. Section 1610(a) of Title 75 is amended to read: 17 § 1610. Commercial driver's license. 18 (a) Content of license.--The commercial driver's license 19 shall indicate "commercial driver's license" or ["CDL"] "CDL," 20 shall comply with the design and manufacturer's standards under 21 section 1510(a) and (a.1) (relating to issuance and content of 22 driver's license) and the smart card technology requirements 23 under section 1510(a.1) and (a.2) and shall include, but not be 24 limited to, the [following information: 25 (1) The name and residential address of the person. 26 (2) The person's color photograph or photographic 27 facsimile. 28 (3) A physical description of the person, including sex, 29 height and eye color. 30 (4) Date of birth. 20050H0510B0548 - 5 -
1 (5) The license number assigned by the department. 2 (6) The person's signature or a facsimile of that 3 signature. 4 (7) The] class or type of commercial motor vehicle or 5 vehicles which the person is authorized to drive, together 6 with any endorsements or restrictions. 7 * * * 8 Section 4. The Department of Transportation shall provide a 9 schedule to phase in the new drivers' licenses over a four-year 10 period which follows the expiration dates for drivers' licenses 11 issued on and after January 1, 2007. 12 Section 5.
