AN ACT 1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An 2 act relating to the public school system, including certain 3 provisions applicable as well to private and parochial 4 schools; amending, revising, consolidating and changing the 5 laws relating thereto," further providing for definitions and 6 for health services. 7 The General Assembly of the Commonwealth of Pennsylvania 8 hereby enacts as follows: 9 Section 1. Section 1401 of the act of March 10, 1949 10 (P.L.30, No.14), known as the Public School Code of 1949, is 11 amended by adding a definition to read: 12 Section 1401. Definitions.--As used in this article-- 13 (13) "Screening for diabetes" means a noninvasive <-- 14 examination that assesses a child's potential to develop 15 diabetes by examining risk factors that include obesity or any 16 other factors consistent with increased risk.
1 * * * <-- 2 (13) "TYPE 2 DIABETES RISK ASSESSMENT" MEANS A NONINVASIVE 3 ASSESSMENT THAT INCLUDES, BUT IS NOT LIMITED TO: (I) DETERMINING 4 WHETHER A CHILD IS OVERWEIGHT OR AT RISK OF BEING OVERWEIGHT, AS 5 DETERMINED BY STANDARDS DEVELOPED BY THE CENTERS FOR DISEASE 6 CONTROL AND PREVENTION; AND (II) ASSESSING WHETHER THE CHILD HAS 7 ANY OF THE FOLLOWING RISK FACTORS: (A) SIGNS OF INSULIN 8 RESISTANCE OR CONDITIONS ASSOCIATED WITH INSULIN RESISTANCE, 9 INCLUDING ACANTHOSIS NIGRICANS, HYPERTENSION, DYSLIPIDEMIA, OR 10 POLYCYSTIC OVARIAN SYNDROME; (B) FAMILY HISTORY OF TYPE 2 11 DIABETES MELLITUS; OR (C) BELONGING TO A RACE OR ETHNICITY WITH 12 KNOWN PREDISPOSITION FOR DEVELOPING TYPE 2 DIABETES. 13 Section 2. Section 1402(a) of the act, amended August 9, <-- 14 1963 (P.L.642, No.340), is amended to read: 15 Section 1402. Health Services.--(a) Each child of school 16 age shall be given by methods established by the Advisory Health 17 Board, (1) a vision test by a school nurse, medical technician 18 or teacher, (2) a hearing test by a school nurse or medical 19 technician, (3) a measurement of height and weight by a school 20 nurse or teacher, (4) tests for tuberculosis under medical 21 supervision, (5) screening for diabetes by a school nurse, 22 medical technician or teacher, and [(5)] (6) such other tests as 23 the Advisory Health Board may deem advisable to protect the 24 health of the child. Vision tests shall be given at least 25 annually and other tests at intervals established by the 26 Advisory Health Board. 27 SECTION 2. SECTION 1402 OF THE ACT IS AMENDED BY ADDING A <-- 28 SUBSECTION TO READ: 29 SECTION 1402. HEALTH SERVICES.--* * * 30 (E.1) A TYPE 2 DIABETES RISK ASSESSMENT SHALL BE COMPLETED 20050H0256B2210 - 2 -
1 AS A REQUIRED PART OF EACH MEDICAL EXAMINATION CONDUCTED 2 PURSUANT TO SUBSECTION (E). A PUPIL SHALL BE CONSIDERED AT RISK 3 OF DEVELOPING TYPE 2 DIABETES IF THE PUPIL IS DETERMINED TO BE 4 OVERWEIGHT OR AT RISK OF BEING OVERWEIGHT AND HAS AT LEAST ONE 5 OF THE OTHER RISK FACTORS OF THE RISK ASSESSMENT. RESULTS OF THE 6 TYPE 2 DIABETES RISK ASSESSMENT SHALL BE DOCUMENTED ON THE 7 CHILD'S MEDICAL REPORT OF EXAMINATION AND BECOME PART OF THE 8 CHILD'S SCHOOL HEALTH RECORD. 9 * * * 10 Section 3.
