AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," extending the expiration 4 of the Health Care Provider Retention Program; and further 5 providing for reporting. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. Sections 1302-A, 1306-A and 1310-A of the act of 9 June 13, 1967 (P.L.31, No.21), known as the Public Welfare Code, 10 added December 23, 2003 (P.L.237, No.44), are amended to read: 11 Section 1302-A. Abatement program. 12 There is hereby established within the Insurance Department a 13 program to be known as the Health Care Provider Retention 14 Program. The Insurance Department, in conjunction with the 15 department, shall administer the program. The program shall 16 provide assistance in the form of assessment abatements to 17 health care providers for calendar years 2003 [and], 2004, 2005, 18 2006 and 2007. 19 Section 1306-A. Reporting.
1 (a) Report.--By May 15, 2004, the Insurance Department shall 2 submit a report to the Governor, the chairperson and the 3 minority chairperson of the Banking and Insurance Committee of 4 the Senate and the chairperson and the minority chairperson of 5 the Insurance Committee of the House of Representatives 6 regarding the program. The Insurance Department shall submit a 7 second report by May 15, 2007. The [report] reports shall 8 include all of the following: 9 (1) The number of health care providers who applied for 10 abatement under the program. 11 (2) The number of health care providers granted 100% 12 abatement under the program. 13 (3) The number of health care providers granted 50% 14 abatement under the program. 15 (4) Based upon available information, the number of 16 health care providers who have left this Commonwealth after 17 receiving abatement under the program. 18 (5) The number of and reason for any unapproved 19 applications. 20 (6) Any other information relevant to assessing the 21 success of the program. 22 (b) Exception.--The [report] reports shall not release 23 information which could reasonably be expected to reveal the 24 individual identity of a health care provider. 25 Section 1310-A. Expiration. 26 The Health Care Provider Retention Program established under 27 this article shall expire December 31, [2005] 2008. 28 Section 2. This act shall take effect in 60 days.
