           THOMPSON, CORMAN, EARLL AND RAFFERTY, MARCH 9, 2004

                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," further providing for Board of
     6     Governors of the State System of Higher Education.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 2004-A(c) of the act of March 10, 1949
    10  (P.L.30, No.14), known as the Public School Code of 1949,
    11  amended June 23, 1988 (P.L.457, No.77), is amended to read:
    12     Section 2004-A.  Board of Governors.--* * *
    13     (c)  (1)  The Governor or his designee, and the Secretary of
    14  Education or his designee, and the members of the General
    15  Assembly shall be members of the board and shall be entitled to
    16  attend all meetings of the board and shall have the right to
    17  speak on all matters before the board, and to vote, but shall
    18  not be elected as an officer of the board.
    19     (2)  A member of the General Assembly appointed under


     1  subsection (a) may designate an official representative to
     2  attend any meetings of the board, the executive committee of the
     3  board and any committee to which the member of the General
     4  Assembly is assigned. Such official representative shall have
     5  the right to speak on all matters before the board, the
     6  executive committee and any committee to which the member of the
     7  General Assembly is assigned but shall not have the right to
     8  vote on behalf of the member of the General Assembly.

    10     Section 2.  This act shall take effect in 60 days.
