SENATE BILL

                                     AN ACT

     1  Amending the act of September 30, 1983 (P.L.160, No.39),
     2     entitled "An act establishing salaries and compensation of
     3     certain public officials including justices and judges of
     4     Statewide courts, judges of courts of common pleas, judges of
     5     the Philadelphia Municipal Court, judges of the Philadelphia
     6     Traffic Court, district justices and the Governor, the
     7     Lieutenant Governor, the State Treasurer, the Auditor
     8     General, the Attorney General and certain other State
     9     officers and the salary and certain expenses of the members
    10     of the General Assembly; and repealing certain inconsistent
    11     acts," further providing for compensation payable to members
    12     of General Assembly.

    13     The General Assembly of the Commonwealth of Pennsylvania
    14  hereby enacts as follows:
    15     Section 1.  Section 4 of the act of September 30, 1983
    16  (P.L.160, No.39), known as the Public Official Compensation Law,
    17  is amended by adding a subsection to read:
    18  Section 4.  Members of the General Assembly.
    19     * * *
    20     (e)  Escrow of salary.--
    21         (1)  Notwithstanding any other provision of this act or
    22     other law to the contrary, the State Treasurer shall hold in


     1     escrow the salary to members of the General Assembly under
     2     this act during any pay period beginning after July 1, in
     3     which:
     4             (i)  The General Appropriations Act has not been
     5         enacted for that fiscal year.
     6             (ii)  The General Appropriations Act has been enacted
     7         for that fiscal year, but more than 15% of the moneys
     8         appropriated from the General Fund in that act have been
     9         vetoed by the Governor and such veto has not been
    10         overridden by the General Assembly.
    11         (2)  The State Treasurer may release the moneys held in
    12     escrow under paragraph (1) at such time as:
    13             (i)  When the escrow occurs as a result of the
    14         condition set forth in paragraph (1)(i), a General
    15         Appropriations Act has been enacted for that fiscal year
    16         and paragraph (1)(ii), does not apply.
    17             (ii)  When the escrow occurs as a result of the
    18         condition set forth in paragraph (1)(ii), a further
    19         appropriations act for the General Fund for that same
    20         fiscal year is enacted after the effective date of the
    21         General Appropriations Act which reduces the percentage
    22         set forth in paragraph (1).
    23     Section 2.  This act shall take effect immediately.
