           REPRESENTATIVES, AS AMENDED, MARCH 15, 2004

                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Governor, to grant and convey to
     3     North Versailles Township THE REDEVELOPMENT AUTHORITY OF       <--
     4     ALLEGHENY COUNTY certain lands situate in North Versailles
     5     Township, Allegheny County; AND AUTHORIZING AND DIRECTING THE  <--
     6     DEPARTMENT OF GENERAL SERVICES, WITH THE APPROVAL OF THE
     7     GOVERNOR, TO GRANT AND CONVEY TO THE LOCK HAVEN UNIVERSITY
     8     FOUNDATION, A NONPROFIT CORPORATION, A CERTAIN TRACT OF LAND
     9     SITUATE IN THE CITY OF LOCK HAVEN, CLINTON COUNTY, IN
    10     EXCHANGE FOR A CERTAIN TRACT OF LAND SITUATE IN THE CITY OF
    11     LOCK HAVEN, CLINTON COUNTY.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14  Section 1.  Conveyance in North Versailles Township, Allegheny
    15                 County.
    16     (a)  Authorization.--The Department of General Services, with
    17  the approval of the Governor, is hereby authorized and directed
    18  on behalf of the Commonwealth of Pennsylvania to grant and
    19  convey to North Versailles Township THE REDEVELOPMENT AUTHORITY   <--
    20  OF ALLEGHENY COUNTY certain land, and any improvements thereon,
    21  described in subsection (b) for $400.

     1     (b)  Property description.--The property to be conveyed
     2  pursuant to this section consists of two tracts of land totaling
     3  approximately 0.21-acres more particularly described as follows:
     4                              TRACT 1
     5     ALL THAT CERTAIN lot or piece of ground situate in the
     6  Township of North Versailles, Allegheny County, and being known
     7  as Lot No. 8 in Block 10 in the Plan of Lots called "Crestas"
     8  laid out by Horace G. Gallinger as recorded in the Recorder's
     9  Office in and for Allegheny County in Plan Book Volume 17, Pages
    10  102 to 104.
    11     CONTAINING 0.10-acres, more or less.
    12     BEING the same tract of land distributed to the Commonwealth
    13  of Pennsylvania by a Decree entered in the Estate of Joseph
    14  Tomasic, Deceased (OC No.4594-1971) dated October 2, 1972, and
    15  recorded in the Recorder's Office in and for Allegheny County in
    16  Deed Book Volume 5147, Page 1.
    17     ALSO BEING designated as Block 457-E, Lot 159 in the records
    18  of the Deed Registry Office of Allegheny County.
    19                              TRACT 2
    20     ALL THAT CERTAIN lot or piece of ground situate in the
    21  Township of North Versailles, Allegheny County, and being known
    22  as Lot No. 9 in Block 10 in the Plan of Lots called "Crestas"
    23  laid out by Horace G. Gallinger as recorded in the Recorder's
    24  Office in and for Allegheny County in Plan Book Volume 17, Pages
    25  102 to 104.
    26     CONTAINING 0.11-acres, more or less.
    27     BEING the same tract of land distributed to the Commonwealth
    28  of Pennsylvania by a Decree entered in the Estate of Joseph
    29  Tomasic, Deceased (OC No.4594-1971) dated October 2, 1972, and
    30  recorded in the Recorder's Office in and for Allegheny County in

     1  Deed Book Volume 5142, Page 1.
     2     ALSO BEING designated as Block 457-E, Lot 157 in the records
     3  of the Deed Registry Office of Allegheny County.
     4     (c)  Conditions of conveyance.--The conveyance shall be made
     5  under and subject to all lawful and enforceable easements,
     6  servitudes and rights of others, including, but not confined to,
     7  streets, roadways and rights of any telephone, telegraph, water,
     8  electric, gas or pipeline companies, as well as under and
     9  subject to any lawful and enforceable estates or tenancies
    10  vested in third persons appearing of record, for any portion of
    11  the land or improvements erected thereon.
    12     (d)  Deed.--The deed of conveyance shall be by Quit Claim
    13  Deed and shall be executed by the Secretary of General Services
    14  in the name of the Commonwealth of Pennsylvania.
    15     (e)  Costs and fees.--Costs and fees incidental to this
    16  conveyance shall be borne by the Grantee.
    17     (f)  Alternative disposition.--In the event that this
    18  conveyance is not executed within 12 months of the effective
    19  date of this act, the property may be disposed of in accordance
    20  with Article SECTION 2406-A of the act of April 9, 1929           <--
    21  (P.L.177, No.175), known as The Administrative Code of 1929.
    22  SECTION 2.  CONVEYANCE IN THE CITY OF LOCK HAVEN, CLINTON         <--
    23                 COUNTY.
    24     (A)  AUTHORIZATION.--THE DEPARTMENT OF GENERAL SERVICES, WITH
    25  THE APPROVAL OF THE GOVERNOR, IS HEREBY AUTHORIZED AND DIRECTED
    26  ON BEHALF OF THE COMMONWEALTH OF PENNSYLVANIA TO GRANT AND
    27  CONVEY TO THE LOCK HAVEN UNIVERSITY FOUNDATION, CERTAIN LAND AS
    28  DESCRIBED IN SUBSECTION (B).
    29     (B)  CONVEYED PROPERTY DESCRIPTION.--THE PROPERTY TO BE
    30  CONVEYED PURSUANT TO SUBSECTION (A) CONSISTS OF ALL THAT CERTAIN

     2  UNIVERSITY OF PENNSYLVANIA OF THE STATE SYSTEM OF HIGHER
     3  EDUCATION IN THE CITY OF LOCK HAVEN, CLINTON COUNTY,
     4  PENNSYLVANIA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:
     5     ALL THAT CERTAIN PIECE OR PARCEL OF LAND SITUATE IN THE THIRD
     6  WARD OF THE CITY OF LOCK HAVEN, CLINTON COUNTY, PENNSYLVANIA,
     7  BOUNDED AND DESCRIBED IN ACCORDANCE WITH A PLAT OF SURVEY
     8  PREPARED BY H. RICHARD OHL, REGISTERED PROFESSIONAL SURVEYOR NO.
     9  7084-E, WOOLRICH, PENNSYLVANIA, DATED JANUARY 14, 1987, AS
    10  FOLLOWS:
    11     BEGINNING AT AN IRON PIN AT THE SOUTHWEST CORNER OF FOURTH
    12  STREET (60 FEET WIDE) AND MARY'S ALLEY (16 FEET WIDE); THENCE

     5     (D)  CONDITIONS OF CONVEYANCE.--THE CONVEYANCE AUTHORIZED BY
     6  SUBSECTION (A) SHALL BE MADE UNDER AND SUBJECT TO ALL LAWFUL AND
     7  ENFORCEABLE EASEMENTS, SERVITUDES AND RIGHTS OF OTHERS,
     8  INCLUDING, BUT NOT CONFINED TO STREETS, ROADWAYS AND RIGHTS OF
     9  ANY TELEPHONE, TELEGRAPH, WATER, ELECTRIC, GAS OR PIPELINE
    10  COMPANIES, AS WELL AS UNDER AND SUBJECT TO ANY LAWFUL AND
    11  ENFORCEABLE ESTATES OR TENANCIES VESTED IN THIRD PERSONS
    12  APPEARING OF RECORD, FOR ANY PORTION OF THE LAND OR IMPROVEMENTS
    13  ERECTED THEREON.
    14     (E)  DEED.--THE DEED OF CONVEYANCE SHALL BE BY SPECIAL
    15  WARRANTY DEED AND SHALL BE EXECUTED BY THE SECRETARY OF GENERAL
    16  SERVICES IN THE NAME OF THE COMMONWEALTH OF PENNSYLVANIA.
    17     (F)  COSTS.--COSTS AND FEES INCIDENTAL TO THIS CONVEYANCE
    18  SHALL BE BORNE BY THE GRANTEE.
