           WONDERLING, RAFFERTY, PILEGGI AND KITCHEN, JULY 15, 2003

        REFERRED TO LOCAL GOVERNMENT, JULY 15, 2003

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled, as
     2     reenacted and amended, "An act concerning townships of the
     3     second class; and amending, revising, consolidating and
     4     changing the law relating thereto," further providing for
     5     real property.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 1503(c) of the act of May 1, 1933
     9  (P.L.103, No.69), known as The Second Class Township Code,
    10  reenacted and amended November 9, 1995 (P.L.350, No.60) and
    11  amended February 21, 2002 (P.L.153, No.12), is amended to read:
    12     Section 1503.  Real Property.--* * *
    13     (c)  The requirements of this section do not apply to
    14  conveyances or leases of real property by a township to any
    15  municipal corporation, the Federal Government, the Commonwealth,
    16  or any institution district, school district, municipality
    17  authority, county, public utility, volunteer fire company,
    18  nonprofit corporation engaged in community industrial,
    19  commercial or affordable housing development, volunteer

     1  ambulance service or volunteer rescue squad located within the
     2  township, nonprofit corporation organized as a public library,
     3  nonprofit medical service corporation, nonprofit housing
     4  corporation, nonprofit organizations providing community service
     5  or development activities [or], nonprofit corporation
     6  established for the preservation of historical, architectural or
     7  aesthetic sites or artifacts or nonprofit association or
     8  nonprofit corporation organized to acquire and maintain real
     9  property for the preservation, conservation and stewardship of
    10  open space. Such conveyances or leases shall be at the sole
    11  discretion of the township.
