SENATE BILL

No. 798 Session of 2004

        REFERRED TO RULES AND EXECUTIVE NOMINATIONS, NOVEMBER 9, 2004

                                     AN ACT

     1  Establishing the Capitol Centennial Commission; providing for
     2     the commission's powers and duties; imposing a penalty; and
     3     providing for funding.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Short title.
     7     This act shall be known and may be cited as the Capitol
     8  Centennial Commission Act.
     9  Section 2.  Declaration of policy.
    10     The General Assembly finds and declares as follows:
    11         (1)  The new Pennsylvania State Capitol building was
    12     dedicated on October 4, 1906.
    13         (2)  President Theodore Roosevelt was the orator of the
    14     day and declared it the "most handsome State Capitol I have
    15     ever seen."
    16         (3)  The Pennsylvania State Capitol was created by
    17     architect Joseph M. Huston and was built and furnished at a
    18     cost of $13,000,000.


     1         (4)  The Pennsylvania State Capitol represents classic
     2     Renaissance style, making it a timeless architectural
     3     treasure.
     4         (5) Over the years the Pennsylvania State Capitol has
     5     seen many changes and improvements.
     6         (6)  The Pennsylvania State Capitol serves as an icon of
     7     the Commonwealth, representing history and government.
     8         (7)  October 4, 2006, will mark the centennial
     9     anniversary of the Pennsylvania State Capitol.
    10  Section 3.  Definitions.
    11     The following words and phrases when used in this act shall
    12  have the meanings given to them in this section unless the
    13  context clearly indicates otherwise:
    14     "Commission."  The Capitol Centennial Commission established
    15  in section 4.
    16  Section 4.  Commission.
    17     (a)  Establishment.--The Capitol Centennial Commission is
    18  hereby established. The commission shall consist of the
    19  following members:
    20         (1)  The Governor or a designee.
    21         (2)  The Lieutenant Governor or a designee.
    22         (3)  The President pro tempore of the Senate or a
    23     designee.
    24         (4)  The Majority Leader of the Senate or a designee.
    25         (5)  The Minority Leader of the Senate or a designee.
    26         (6)  The Speaker of the House of Representatives or a
    27     designee.
    28         (7)  The Majority Leader of the House of Representatives
    29     or a designee.
    30         (8)  The Minority Leader of the House of Representatives

     1     or a designee.
     2         (9)  The Chief Justice of the Supreme Court of
     3     Pennsylvania or a designee.
     4         (10)  The chairman of the Capitol Preservation Committee
     5     or a designee.
     6     (b)  Cochairpersons.--The following are appointed as
     7  cochairpersons of the commission:
     8         (1)  The Lieutenant Governor.
     9         (2)  The President pro tempore of the Senate.
    10         (3)  The Speaker of the House of Representatives.
    11     (c)  Meetings.--Meetings of the commission shall be called by
    12  the cochairpersons.
    13     (d)  Director.--The cochairpersons of the commission shall
    14  appoint a director or codirectors.
    15  Section 5.  Powers and duties.
    16     (a)  General rule.--The commission shall make determinations
    17  regarding celebratory events, materials, information and other
    18  matters that occur in conjunction with the centennial
    19  anniversary of the Pennsylvania State Capitol and concomitant
    20  celebration.
    21     (b)  Events.--Only those events designated by the commission
    22  as part of the Capitol Centennial Celebration shall be
    23  officially sanctioned events.
    24     (c)  Authorization.--The terms "Capitol Centennial" and
    25  "Capitol Centennial Celebration" shall be authorized by the
    26  commission for use in officially sanctioned events.
    27  Section 6.  Violation.
    28     The use of the term "Capitol Centennial" or "Capitol
    29  Centennial Celebration" in an advertisement designed to attract
    30  the general public to an event is prohibited unless authorized

     1  by the commission. A person who violates this section commits a
     2  misdemeanor of the third degree and shall, upon conviction, be
     3  sentenced to pay a fine of not more than $1,000.
     4  Section 7.  Funding.
     5     Moneys appropriated under the act of July 4, 2004 (P.L.    ,
     6  No.7A) known as the General Appropriation Act of 2004, by the
     7  General Assembly for use in the Centennial of the Capitol shall
     8  be used exclusively by the commission.
     9  Section 8.  Expiration.
    10     The commission shall expire on June 30, 2008.
    11  Section 9.  Effective date.
    12     This act shall take effect immediately.
