                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," providing for student achievement
     6     programs; and making an appropriation.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the Public School Code of 1949, is amended by adding an
    11  article to read:
    12                           ARTICLE XXV-A
    13                        STUDENT ACHIEVEMENT
    14  Section 2501-A.  Funding for certain programs.
    15     Funding for the following programs shall be provided from
    16  appropriations provided for student achievement:
    17         (1)  Rural high school math and science teachers as
    18     provided in section 1156.
    19         (2)  Math and literacy coaches as provided in section

     1     1205.5.
     2         (3)  Family resource centers as provided in Article XIV-
     3     A.
     4         (4)  Tutoring as provided in section 1501-D.
     5         (5)  Science and Applied Knowledge Program as provided in
     6     section 1502-D.
     7  Section 2502-A.  Plan.
     8     In order to receive funding under this section, an eligible
     9  school district shall submit a plan to the Department of
    10  Education detailing the use of the funds pursuant to guidelines
    11  issued by the department for the programs within student
    12  achievement. The department may approve all or part of the plan,
    13  modify the plan in consultation with the school district, or
    14  disapprove the plan. The department shall notify the school
    15  district of the amount of funding the school district shall
    16  receive under the plan. Funds shall only be used by the school
    17  district in accordance with the plan approved by the department.
    18  Section 2503-A.  Placement of funds in reserve account
    19                 prohibited.
    20     School districts qualifying to receive funds from the
    21  Commonwealth in school years 2003-2004 and thereafter under this
    22  section who have been providing tutoring programs in the manner
    23  provided for in each program shall not place any then available
    24  local, Federal or Commonwealth funds previously used for these
    25  programs in any reserve account.
    26  Section 2504-A.  Payment.
    27     Payment to school districts under this article shall be made
    28  based on the amounts approved by the Department of Education. No
    29  contract or grant agreement shall be required in order for the
    30  department to make these payments. Payments shall be made to

     1  school districts in installments during a fiscal year.
     2     Section 2.  The sum of $204,997,000 is hereby appropriated
     3  from the General Fund to the Department of Education for a
     4  period beginning July 1, 2003, for the purposes set forth in
     5  Article XXV-A of the act. This appropriation shall be a three-
     6  year continuing appropriation and shall not lapse until June 30,
     7  2006.
     8     Section 3.  This act shall take effect July 1, 2003, or
     9  immediately, whichever is later.
