SENATE BILL

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, requiring certain notice
     3     by local agency.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 42 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 8503.  Notice regarding grant of easement or right-of-way.
     9     A governmental or municipal subdivision or agency that seeks
    10  to acquire an interest in real estate, including, but not
    11  limited to, an easement or right-of-way, shall post at the
    12  beginning of the transfer document the following language,
    13  substituting accurate information for the generic phrases in
    14  parentheses and in substantially this form:
    15                   NOTICE OF INTENDED CONVEYANCE
    16         The (governmental or municipal) (agency or subdivision)
    17         seeks to acquire a(n) (easement) (right-of-way) (other
    18         property entitlement) from you. You are not required to

     1         grant this conveyance. By signing this document, you
     2         could be irrevocably granting or surrendering important
     3         legal rights and/or valuable property interests, and you
     4         could be waiving or compromising your rights to receive
     5         suitable monetary compensation for the conveyance. You
     6         should take this document to and review it with your
     7         lawyer before deciding whether to sign it. If you do not
     8         have an attorney, go to or telephone the office set forth
     9         below to find out where you can get legal assistance.
