                                     AN ACT

     1  Amending the act of July 10, 1986 (P.L.1398, No.122), entitled
     2     "An act establishing a special fund for moneys received by
     3     the Commonwealth from resolution of oil overcharge matters;
     4     designating certain low-income energy conservation and
     5     assistance programs for funding from this special fund; and
     6     making appropriations," creating the Fuel Oil Reserve
     7     Account; and making an appropriation.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of July 10, 1986 (P.L.1398, No.122),
    11  known as the Energy Conservation and Assistance Act, is amended
    12  by adding sections to read:
    13  Section 4.1.  Establishment of special account.
    14     There is hereby created a restricted receipt account to be
    15  known as the Fuel Oil Reserve Account, for the purpose of
    16  offsetting unexpected, sudden and severe increases in the cost
    17  of fuel oil. Whenever the cost of fuel oil rises more than 25%
    18  within any consecutive 60-day period, moneys within the account
    19  may be utilized and distributed in the supplemental program
    20  established in section 5(a)(2).

     1  Section 4.2.  Appropriation.
     2     The sum of $25,000,000, or as much thereof as may be
     3  necessary, is hereby appropriated to the Fuel Oil Reserve
     4  Account for the fiscal year July 1, 2003, to June 30, 2004, to
     5  carry out the purposes of section 4.1.
     6     Section 2.  This act shall take effect July 1, 2003, or
     7  immediately, whichever is later.
