        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, JULY 15, 2003

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     criminal victim aid good Samaritan civil immunity.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8331.3 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8331.3.  Criminal victim aid good Samaritan civil immunity.
     9     (a)  General rule.--Any person who provides or obtains or
    10  attempts to provide or obtain assistance for a victim of a
    11  PERSONAL INJURY crime [involving death, serious physical injury,  <--
    12  robbery, burglary, kidnapping, rape, statutory sexual assault,
    13  involuntary deviate sexual intercourse, sexual assault,
    14  aggravated indecent assault or indecent assault] at the scene of
    15  the [criminal act] personal injury crime or attempted [criminal
    16  act] personal injury crime shall not be liable for any civil
    17  damages as a result of any acts or omissions in providing or

     1  obtaining or attempting to provide or obtain assistance, except
     2  any acts or omissions intentionally designed to harm or any acts
     3  or omissions that constitute gross negligence or willful, wanton
     4  or reckless conduct.
     5     (b)  Definitions.--The terms "personal injury crime" and
     6  "victim" shall have the same meanings given to them in section
     7  103 of the act of November 24, 1998 (P.L.882, No.111), known as
     8  the Crime Victims Act.
     9     Section 2.  This act shall take effect in 60 days.
