SENATE BILL

           RAFFERTY, LOGAN, STOUT, TARTAGLIONE, PUNT, WOZNIAK, O'PAKE,
           KASUNIC AND SCHWARTZ, FEBRUARY 4, 2003

                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, further providing for
     3     criminal victim aid good Samaritan civil immunity.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8331.3 of Title 42 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 8331.3.  Criminal victim aid good Samaritan civil immunity.
     9     (a)  General rule.--Any person who provides or obtains or
    10  attempts to provide or obtain assistance for a victim of a crime
    11  [involving death, serious physical injury, robbery, burglary,
    12  kidnapping, rape, statutory sexual assault, involuntary deviate
    13  sexual intercourse, sexual assault, aggravated indecent assault
    14  or indecent assault] at the scene of the [criminal act] personal
    15  injury crime or attempted [criminal act] personal injury crime
    16  shall not be liable for any civil damages as a result of any
    17  acts or omissions in providing or obtaining or attempting to
    18  provide or obtain assistance, except any acts or omissions

     1  intentionally designed to harm or any acts or omissions that
     2  constitute gross negligence or willful, wanton or reckless
     3  conduct.
     4     (b)  Definitions.--The terms "personal injury crime" and
     5  "victim" shall have the same meanings given to them in section
     6  103 of the act of November 24, 1998 (P.L.882, No.111), known as
     7  the Crime Victims Act.
     8     Section 2.  This act shall take effect in 60 days.
