                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for possession of
     3     weapon on school property.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 912(b) of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 912.  Possession of weapon on school property.

    11     (b)  Offense defined.--A person commits [a misdemeanor of the
    12  first degree] an offense if he possesses a weapon in the
    13  buildings of, on the grounds of, or in any conveyance providing
    14  transportation to or from any elementary or secondary publicly-
    15  funded educational institution, any elementary or secondary
    16  private school licensed by the Department of Education or any
    17  elementary or secondary parochial school.
    18     (b.1)  Grading.--

     1         (1)  Except as otherwise provided in paragraph (2), an
     2     offense under subsection (b) is a misdemeanor of the first
     3     degree.
     4         (2)  An offense under subsection (b) is a felony of the
     5     third degree if the weapon possessed is a firearm, shotgun or
     6     rifle.
