AN ACT 1 Providing for the reporting of crimes of violence committed on 2 the grounds of school entities; establishing a mandatory 3 uniform school violence reporting system; and making a 4 repeal. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Short title. 8 This act shall be known and may be cited as the School 9 Violence Mandatory Uniform Reporting Act. 10 Section 2. Definitions. 11 The following words and phrases when used in this act shall 12 have the meanings given to them in this section unless the 13 context clearly indicates otherwise: 14 "Crime of violence." Any of the following offenses: murder 15 or any criminal homicide; aggravated assault; simple assault; 16 rape; involuntary deviate sexual intercourse; arson; kidnapping; 17 robbery; terroristic threats; harassment; stalking; possession 18 of a weapon on school property; possession of an offensive
1 weapon; possession of an instrument of crime or robbery of a 2 motor vehicle; or criminal attempt, criminal conspiracy or 3 criminal solicitation to commit any of these offenses. 4 "Law enforcement agency." The Pennsylvania State Police, the 5 district attorney of the county in which a school is located and 6 the police department with primary jurisdiction over the area in 7 which school grounds or property is located or where a crime of 8 violence is alleged to have occurred. 9 Section 3. Uniform reporting system. 10 (a) General rule.--The Pennsylvania State Police shall 11 establish and administer a mandatory uniform reporting system 12 which shall be utilized by any public, private, parochial, 13 vocational or charter school, including, but not limited to, 14 college or university, for the purpose of reporting all 15 incidents of a crime of violence which occur on the grounds or 16 property of the school, college or university. The reporting 17 system developed by the Pennsylvania State Police shall include 18 a single uniform report form consistent with subsection (b) and 19 a protocol of reporting to be followed by school officials and 20 law enforcement agencies as set forth in subsection (c). 21 (b) Contents of uniform report form.--The incident report 22 shall include, but is not limited to, the following: 23 (1) A brief narrative for the incident, including the 24 date, time and circumstances of the incident. 25 (2) What, if any, weapons were used or threatened to be 26 used. 27 (3) A description of any injuries. 28 (4) A description of any evidence that would tend to 29 establish that a crime of violence was committed. 30 (5) An indication of whether law enforcement was 20030S0135B0130 - 2 -
1 contacted and whether an arrest was made. 2 (6) If an arrest was made, the offense with which the 3 accused was charged. 4 (c) Reporting protocol.--The Pennsylvania State Police shall 5 issue a uniform reporting protocol for all schools employing the 6 uniform reporting system and law enforcement agencies. The 7 protocol shall include, but is not limited, to: 8 (1) Instructions as to when and how uniform report forms 9 are to be filed with law enforcement agencies and the 10 Pennsylvania State Police by a principal, dean or other 11 person who acts as a chief operating or executive officer of 12 a school, college or university. 13 (2) Instructions as to when and how each law enforcement 14 agency shall transmit to the Pennsylvania State Police the 15 information specified in subsection (b) related to crimes of 16 violence on school grounds or property. 17 (d) Annual report.--The Pennsylvania State Police shall 18 annually compile and analyze the incident report data received 19 and publish a Statewide report concerning crimes of violence on 20 school grounds and property. The Pennsylvania State Police shall 21 transmit a copy of the annual report to the Governor and to the 22 General Assembly. 23 Section 4. Repeal. 24 The provisions of 18 Pa.C.S. Ch. 91 are repealed insofar as 25 they are inconsistent with this act. 26 Section 5. Effective date. 27 This act shall take effect in 60 days. A16L24JS/20030S0135B0130 - 3 -
