AN ACT
1 Amending Title 42 (Judiciary and Judicial Procedure) of the
2 Pennsylvania Consolidated Statutes, prohibiting the
3 imposition of the death sentence for persons 17 years of age
4 or younger.
5 The General Assembly of the Commonwealth of Pennsylvania
6 hereby enacts as follows:
7 Section 1. Section 9711 of Title 42 of the Pennsylvania
8 Consolidated Statutes is amended by adding a subsection to read:
9 § 9711. Sentencing procedure for murder of the first degree.

11 (e.1) Minimum age.--A sentence of death shall not be imposed
12 upon a person who was 17 years of age or younger at the time of
13 the commission of the offense.

15 Section 2. This act shall take effect in 60 days.
