                                     AN ACT

     1  Requiring gasoline stations to provide access to restrooms; and
     2     imposing a penalty.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Short title.
     6     This act shall be known and may be cited as the Gasoline
     7  Station Restroom Access Act.
     8  Section 2.  Definitions.
     9     The following words and phrases when used in this act shall
    10  have the meanings given to them in this section unless the
    11  context clearly indicates otherwise:
    12     "Gasoline station."  A place of business engaging in the sale
    13  at retail of gasoline, diesel fuel or kerosene.
    14  Section 3.  Requirement and prohibition.
    15     (a)  Requirement.--A gasoline station shall provide access to
    16  restrooms to the public at large.
    17     (b)  Prohibition.--A gasoline station may not condition


     1  access to restrooms upon being a patron of the gasoline station.
     2  Section 4.  Penalty.
     3     A person that violates section 3 commits a summary offense.
     4  Section 10.  Effective date.
     5     This act shall take effect in 60 days.
