AN ACT 1 Amending the act of May 29, 1956 (1955 P.L.1840, No.610), 2 entitled, as amended, "An act defining and providing for the 3 licensing of water well drillers; prevention of pollution of 4 underground waters; conferring powers and imposing duties on 5 the Bureau of Topographic and Geologic Survey; and 6 prescribing penalties and fees," further providing for 7 license required to drill water wells, for application and 8 for records and reports. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Sections 4(a) and 6(a) of the act of May 29, 1956 12 (1955 P.L.1840, No.610), known as the Water Well Drillers 13 License Act, are amended to read: 14 Section 4. License Required to Drill Water Wells.--(a) 15 After the effective date of this act, no person shall drill a 16 water well within the Commonwealth, unless he has first secured 17 from the department a license issued in such form and subject to 18 such reasonable rules and regulations as the department shall 19 prescribe, or unless he is drilling such well within the scope
1 of his employment by a licensed well driller. Any person 2 operating a drilling rig shall be certified in accordance with 3 section 6(a)(6). 4 * * * 5 Section 6. Application.--(a) Before any water well 6 driller's license is issued, application shall be made, in 7 writing, to the department on a form prepared and furnished by 8 the department. Such application shall contain a statement 9 showing (1) the name of the applicant, (2) the business address 10 of the applicant, (3) the residence of the applicant, (4) the 11 number of drilling rigs the applicant intends to operate during 12 the license year and a short description of each rig, (5) such 13 additional information as the department may require[.] and (6) 14 proof of having passed a certification examination offered by 15 the National Ground Water Association for each drilling rig 16 operator. Such documentation may be provided to the department 17 through electronic means or other written means. 18 * * * 19 Section 2. Section 10 of the act is amended by adding a 20 subsection to read: 21 Section 10. Records and Reports.--* * * 22 (d) The department shall compile and maintain a current 23 registry of water well drillers and water well drilling rig 24 operators. Such registry shall be made available to the public. 25 The department may make the registry available on its World Wide 26 Web site. 27 Section 3. This act shall take effect in one year.
