AN ACT
1 To provide from the General Fund for the expenses of the
2 Executive, Legislative and Judicial Departments of the
3 Commonwealth, the public debt and for the public schools for
4 the fiscal year July 1, 2004, to June 30, 2005, for certain
5 institutions and organizations, and for the payment of bills
6 incurred and remaining unpaid at the close of the fiscal year
7 ending June 30, 2004; to provide appropriations from the
8 State Lottery Fund, the Energy Conservation and Assistance
9 Fund, the Hazardous Material Response Fund, The State Stores
10 Fund, the Milk Marketing Fund, the Home Investment Trust
11 Fund, the Emergency Medical Services Operating Fund, the
12 Tuition Payment Fund, the Banking Department Fund, the
13 Firearm Records Check Fund, the Ben Franklin Technology
14 Development Authority Fund, the Tobacco Settlement Fund and
15 the Health Care Provider Retention Account to the Executive
16 Department; to provide appropriations from the Judicial
17 Computer System Augmentation Account to the Judicial
18 Department for the fiscal year July 1, 2004, to June 30,
19 2005; to provide appropriations from the Motor License Fund
20 for the fiscal year July 1, 2004, to June 30, 2005, for the
21 proper operation of the several departments of the
22 Commonwealth and the Pennsylvania State Police authorized to
23 spend Motor License Fund moneys; to provide for the
24 appropriation of Federal funds to the Executive Department of
25 the Commonwealth and for the establishment of restricted
26 receipt accounts for the fiscal year July 1, 2004, to June
27 30, 2005, and for the payment of bills remaining unpaid at
28 the close of the fiscal year ending June 30, 2004; to provide
29 for the additional appropriation of Federal and State funds
30 from the General Fund, for the Executive Department of the
31 Commonwealth for the fiscal year July 1, 2003, to June 30,
32 2004, and for the payment of bills incurred and remaining
33 unpaid at the close of the fiscal year ending June 30, 2003.

13 The General Assembly of the Commonwealth of Pennsylvania
14 hereby enacts as follows:
15 PART I
16 GENERAL PROVISIONS
17 Section 101. Short title.--This act shall be known and may
18 be cited as the General Appropriation Act of 2004.
19 Section 102. Definitions.--The following words and phrases
20 when used in this act shall have the meanings given to them in
21 this section unless the context clearly indicates otherwise:
22 "Employees." Includes all directors, superintendents, bureau
23 or division chiefs, assistant directors, assistant
24 superintendents, assistant chiefs, experts, scientists,
25 engineers, surveyors, draftsmen, accountants, secretaries,
26 auditors, inspectors, examiners, analysts, statisticians,
27 marshals, clerks, stenographers, bookkeepers, messengers and
28 other assistants in any department, board or commission.
29 "Expenses" and "maintenance." Includes all printing, binding
30 and stationery, food and forage, materials and supplies,

1 traveling expenses, training, motor vehicle supplies and
2 repairs, freight, express and cartage, postage, telephones and
3 telegraph rentals and toll charges, newspaper advertising and
4 notices, public advertising by or through any medium, fuel,
5 light, heat, power and water, minor construction and renovation,
6 repairs or reconstruction of equipment, buildings and
7 facilities, rent of real estate and equipment, premiums on
8 workers' compensation, insurance premiums on policies of
9 liability insurance, insurance premiums on medical payment
10 insurance and surety bonds for volunteer workers, premiums on
11 employee group life insurance and employee and retired employee
12 group hospital and medical insurance, payment of Commonwealth
13 share of Social Security taxes and unemployment compensation
14 costs for State employees, the purchase of replacement or
15 additional equipment and machinery and all other incidental
16 costs and expenses, including payment to the Department of
17 General Services of mileage and other charges for the use of
18 automobiles and rental payments for permanently assigned
19 automobiles and of expenses or costs of services incurred
20 through the Purchasing Fund. The term "expenses" also shall
21 include the medical costs for the treatment of inmates of State
22 institutions when the inmate must be transferred to an outside
23 hospital: Provided, That in no case shall the State institution
24 pay more for patient care than that provided under the State
25 medical assistance program.
26 Section 103. Abbreviations.--The following abbreviations
27 when used in this act shall have the meanings given to them in
28 this section unless the context clearly indicates otherwise:

29 Section 104. State appropriations.--(a) General Fund.--The
30 following sums set forth in this act, or as much thereof as may

1 be necessary, are hereby specifically appropriated from the
2 General Fund to the several hereinafter named agencies of the
3 Executive, Legislative and Judicial Departments of the
4 Commonwealth for the payment of salaries, wages or other
5 compensation and travel expenses of the duly elected or
6 appointed officers and employees of the Commonwealth, for the
7 payment of fees for contractual services rendered, for the
8 purchase or rental of goods and services, printing, public
9 advertising by or through any medium, equipment, land and
10 buildings and for payment of any other expenses, as provided by
11 law or by this act, necessary for the proper conduct of the
12 duties, functions and activities and for the purposes
13 hereinafter set forth for the fiscal year beginning July 1,
14 2004, and for the payment of bills incurred and remaining unpaid
15 at the close of the fiscal year ending June 30, 2004.
16 (b) State Lottery Fund.--The following sums set forth in
17 this act, or as much thereof as may be necessary, are hereby
18 specifically appropriated from the State Lottery Fund to the
19 several hereinafter named agencies of the Executive Department
20 of the Commonwealth for the payment of salaries, wages or other
21 compensation and travel expenses of the duly appointed officers
22 and employees of the Commonwealth, for the payment of fees for
23 contractual services rendered, for the purchase or rental of
24 goods and services and for payment of any other expenses, as
25 provided by law or by this act, necessary for the proper conduct
26 of the duties, functions and activities and for the purposes
27 hereinafter set forth for the fiscal year beginning July 1,
28 2004, and for the payment of bills incurred and remaining unpaid
29 at the close of the fiscal year ending June 30, 2004.
30 (c) Energy Conservation and Assistance Fund.--The following

1 sums set forth in this act, or as much thereof as may be
2 necessary, are hereby specifically appropriated from the Energy
3 Conservation and Assistance Fund to the several hereinafter
4 named agencies of the Executive Department of the Commonwealth
5 for the payment of fees for contractual services rendered, for
6 the purchase or rental of goods and services and for the payment
7 of any other expenses, as provided by law or by this act,
8 necessary for the proper conduct of the duties, functions and
9 activities and for the purposes hereinafter set forth for the
10 fiscal year beginning July 1, 2004, and for the payment of bills
11 incurred and remaining unpaid at the close of the fiscal year
12 ending June 30, 2004.
13 (d) Judicial Computer System Augmentation Account.--The
14 following sums set forth in this act, or as much thereof as may
15 be necessary, are hereby specifically appropriated from the
16 restricted receipt account established within the General Fund,
17 known as the Judicial Computer System Augmentation Account, to
18 the Judicial Department of the Commonwealth for the payment of
19 salaries, wages or other compensation and travel expenses, for
20 the payment of fees for contractual services rendered, for the
21 purchase or rental of goods and services and for the payment of
22 any other expenses, as provided by law or by this act, necessary
23 for the proper conduct of the duties, functions and activities
24 and for the purposes hereinafter set forth for the fiscal year
25 beginning July 1, 2004, and for the payment of bills incurred
26 and remaining unpaid at the close of the fiscal year ending June
27 30, 2004.
28 (e) Emergency Medical Services Operating Fund.--The
29 following sums set forth in this act, or as much thereof as may
30 be necessary, are hereby specifically appropriated from the

1 Emergency Medical Services Operating Fund to the several
2 hereinafter named agencies of the Executive Department of the
3 Commonwealth for the payment of fees for contractual services
4 rendered, for the purchase or rental of goods and services and
5 for the payment of any other expenses, as provided by law or by
6 this act, necessary for the proper conduct of the duties,
7 functions and activities and for the purposes hereinafter set
8 forth for the fiscal year beginning July 1, 2004, and for the
9 payment of bills incurred and remaining unpaid at the close of
10 the fiscal year ending June 30, 2004.
11 (f) The State Stores Fund.--The following sums set forth in
12 this act, or as much thereof as may be necessary, are hereby
13 specifically appropriated from The State Stores Fund to the
14 hereinafter named agency of the Executive Department of the
15 Commonwealth for the payment of salaries, wages or other
16 compensation and travel expenses of the duly appointed officers
17 and employees of the Commonwealth, for the payment of fees for
18 contractual services rendered, for the purchase or rental of
19 goods and services and for the payment of any other expenses, as
20 provided by law or by this act, necessary for the proper conduct
21 of the duties, functions and activities and for the purposes
22 hereinafter set forth for the fiscal year beginning July 1,
23 2004, and for the payment of bills incurred and remaining unpaid
24 at the close of the fiscal year ending June 30, 2004.
25 (g) Motor License Fund.--The following sums, or as much
26 thereof as may be necessary, are hereby appropriated from the
27 Motor License Fund to the hereinafter named agencies of the
28 Executive Department for the payment of salaries, wages and
29 other compensation and travel expenses of the duly elected or
30 appointed officers and employees of the Commonwealth, for

1 contractual services and other expenses necessary for the proper
2 conduct of the duties, functions and activities for the purposes
3 hereinafter set forth for the fiscal year beginning July 1,
4 2004, and for the payment of bills incurred and remaining unpaid
5 at the close of the fiscal year ending June 30, 2004.
6 (h) Aviation Restricted Revenue Account.--The following
7 sums, or as much thereof as may be necessary, are hereby
8 appropriated from the Aviation Restricted Revenue Account in the
9 Motor License Fund to the hereinafter named agencies of the
10 Executive Department for the purposes set forth herein for the
11 fiscal year beginning July 1, 2004, and for the payment of bills
12 incurred and remaining unpaid at the close of the fiscal year
13 ending June 30, 2004.
14 (i) Hazardous Material Response Fund.--The following sums
15 set forth in this act, or as much thereof as may be necessary,
16 are hereby specifically appropriated from the Hazardous Material
17 Response Fund to the several hereinafter named agencies of the
18 Executive Department of the Commonwealth for the payment of fees
19 for contractual services rendered, for the purchase or rental of
20 goods and services and for the payment of any other expenses, as
21 provided by law or by this act, necessary for the proper conduct
22 of the duties, functions and activities and for the purposes
23 hereinafter set forth for the fiscal year beginning July 1,
24 2004, and for the payment of bills incurred and remaining unpaid
25 at the close of the fiscal year ending June 30, 2004.
26 (j) Milk Marketing Fund.--The following sums set forth in
27 this act, or as much thereof as may be necessary, are hereby
28 specifically appropriated from the Milk Marketing Fund to the
29 several hereinafter named agencies of the Executive Department
30 of the Commonwealth for the payment of salaries, wages or other

1 compensation and travel expenses of the duly appointed officers
2 and employees of the Commonwealth, for the payment of fees for
3 contractual services rendered, for the purchase or rental of
4 goods and services and for the payment of any other expenses, as
5 provided by law or by this act, necessary for the proper conduct
6 of the duties, functions and activities and for the purposes
7 hereinafter set forth for the fiscal year beginning July 1,
8 2004, and for the payment of bills incurred and remaining unpaid
9 at the close of the fiscal year ending June 30, 2004.
10 (k) Home Investment Trust Fund.--The following sums set
11 forth in this act, or as much thereof as may be necessary, are
12 hereby specifically appropriated from the Home Investment Trust
13 Fund to the hereinafter named agencies of the Executive
14 Department of the Commonwealth for the payment of salaries,
15 wages or other compensation and travel expenses of the duly
16 appointed officers and employees of the Commonwealth, for the
17 payment of fees for contractual services rendered, for the
18 purchase or rental of goods and services and for the payment of
19 any other expenses, as provided by law or by this act, necessary
20 for the proper conduct of the duties, functions and activities
21 and for the purposes hereinafter set forth for the fiscal year
22 beginning July 1, 2004, and for the payment of bills incurred
23 and remaining unpaid at the close of the fiscal year ending June
24 30, 2004.
25 (l) Tuition Payment Fund.--The following sums set forth in
26 this act, or as much thereof as may be necessary, are hereby
27 specifically appropriated from the Tuition Payment Fund to the
28 hereinafter named agencies of the Executive Department of the
29 Commonwealth for the payment of salaries, wages or other
30 compensation and travel expenses of the duly appointed officers

1 and employees of the Commonwealth, for the payment of fees for
2 contractual services rendered, for the purchase or rental of
3 goods and services and for the payment of any other expenses, as
4 provided by law or by this act, necessary for the proper conduct
5 of the duties, functions and activities and for the purposes
6 hereinafter set forth for the fiscal year beginning July 1,
7 2004, and for the payment of bills incurred and remaining unpaid
8 at the close of the fiscal year ending June 30, 2004.
9 (m) Banking Department Fund.--The following sums set forth
10 in this act, or as much thereof as may be necessary, are hereby
11 specifically appropriated from the Banking Department Fund to
12 the hereinafter named agencies of the Executive Department of
13 the Commonwealth for the payment of salaries, wages or other
14 compensation and travel expenses of the duly appointed officers
15 and employees of the Commonwealth, for the payment of fees for
16 contractual services rendered, for the purchase or rental of
17 goods and services and for the payment of any other expenses, as
18 provided by law or by this act, necessary for the proper conduct
19 of the duties, functions and activities and for the purposes
20 hereinafter set forth for the fiscal year beginning July 1,

15 Section 105. Federal augmentation appropriations.--The
16 following Federal augmentation appropriations set forth in this

20 Department of the Commonwealth for the payment of the expenses

27 Section 106. Block grants.--(a) Appropriation.--The
28 following sums set forth in this act, or as much thereof as may
29 be necessary, are hereby specifically appropriated from the
30 block grant (BG) funds to the several hereinafter named agencies

1 of the Executive Department of the Commonwealth for the
2 purposes, and under the restrictions, for which the funds are

4 (b) Small Communities Development Block Grant.--The Small
5 Communities Development Block Grant (SCDBG) is to assist small
6 cities and communities that have a high concentration of
7 impoverished citizens and substandard housing to expand their
8 low-income and moderate-income housing opportunities and to meet
9 community development needs.
10 (c) Community Services Block Grant.--The Community Services
11 Block Grant (CSBG) is to provide a range of services and
12 activities having a measurable and potentially major impact on
13 the causes of poverty in the community or those areas of the
14 community where poverty is a particularly acute problem. In
15 addition, new focus may be placed on the unemployed, both old
16 and new. Local agencies may lower their eligibility requirements
17 for recipients to three months to allow greater flexibility to
18 assure proper consideration of each recipient.
19 (d) Preventive Health and Health Services Block Grant.--The
20 Preventive Health and Health Services Block Grant (PHHSBG) is
21 for the provision of preventive health and other health services
22 related to emergency medical systems, health initiative grants,
23 comprehensive public health, hypertension, fluoridation, health
24 education, risk reduction, home health, rape crisis and domestic
25 violence services.
26 (e) Maternal and Child Health Services Block Grant.--The
27 Maternal and Child Health Services Block Grant (MCHSBG) is to
28 enable states to maintain and strengthen their leadership in
29 planning, promoting, coordinating and evaluating health care for
30 pregnant women, mothers, infants and children, and children with

1 special health care needs, and in providing health services for
2 mothers and children who do not have access to adequate health
3 care.
4 (f) Low-Income Home Energy Assistance Block Grant.--The Low-
5 Income Home Energy Assistance Block Grant (LIHEABG) is to help
6 lessen the impact of the high cost of energy on low-income
7 families and individuals, including energy efficiency grants for
8 low-income dwellings. No less than 15% of the LIHEABG funds
9 received shall be used for weatherization. LIHEABG funds
10 received pursuant to a Presidential release of contingency funds
11 shall be exempt from the 15% requirement. Unexpended
12 weatherization funds which would result in LIHEABG funds being
13 returned to the Federal Department of Health and Human Services
14 may be spent for assistance grants at the discretion of the
15 Secretary of the Budget. The Secretary of the Budget shall
16 notify the chairman and the minority chairman of the
17 Appropriations Committee of the Senate and the chairman and the
18 minority chairman of the Appropriations Committee of the House
19 of Representatives of the intent to reallocate any such funds
20 ten days prior to any reallocation.
21 (g) Social Services Block Grant.--The Social Services Block
22 Grant (SSBG) is for the provision of social services to eligible
23 persons.
24 (h) Mental Health Services Block Grant.--The Mental Health
25 Services Block Grant (MHSBG) provides funds for the provision of
26 services to adults with serious mental illness or children with
27 serious emotional disturbance.
28 (i) Substance Abuse Block Grant.--The Substance Abuse Block
29 Grant (SABG) provides funds to establish and maintain programs
30 to combat alcohol and drug abuse.

28 for or perform abortions or engage in
29 any counseling which is inconsistent

4 $4,343,000 shall be used for grants
5 for women's medical services,
6 including noninvasive contraception
7 supplies. These funds shall not be
8 used to promote, perform or refer for
9 abortions or engage in abortion
10 counseling and projects supported by
11 these funds shall be physically and
12 financially separate from any such
13 abortion or abortion-related
14 activities. This separation shall be
15 verified by an annual independent
16 audit obtained by the entity providing
17 the services and submitted to the
18 Department of Public Welfare. Further
19 evidence of such physical and
20 financial separation shall be supplied
21 through such documentation as the
22 Department of Public Welfare shall
23 request. No later than March 30 of
24 each year, the Department of Public
25 Welfare shall submit a report to the
26 chairman and minority chairman of the
27 Appropriations Committee of the Senate
28 and the chairman and minority chairman
29 of the Appropriations Committee of the
30 House of Representatives and to the

14 Section 1891. Prior laws unaffected.--This act is not
15 intended to be inconsistent with or to repeal any provision of
16 any act enacted at this or any prior session of the General
17 Assembly regulating the purchase of supplies, the ordering of
18 printing and binding, the purchase, maintenance and use of
19 automobiles, the method of making payments from the State
20 Treasury for any purpose or the functioning of any
21 administrative department, board or commission.
22 Section 1892. Compliance with other law before funds
23 available.--No appropriation made by this part to any
24 department, board, commission or agency of the Executive
25 Department shall be available unless and until the department,
26 board, commission or agency has complied with sections 615 and
27 616 of the act of April 9, 1929 (P.L.177, No.175), known as The
28 Administrative Code of 1929.
29 Section 1893. Contracts prerequisite to encumbering or
30 committing funds.--Funds for the purchase of supplies, materials

1 and equipment shall not be deemed to be committed or encumbered
2 until contracts covering the purchase have been entered into
3 with the vendors.
4 Section 1894. Minority business set-asides.--(a) Each
5 department or other instrumentality of the Commonwealth listed
6 in Subpart B authorized to contract for buildings, highways,
7 commodities, equipment, supplies or services shall report to the
8 General Assembly all information pertinent to anticipated
9 procurement needs at the beginning of each fiscal year and each
10 fiscal quarter thereafter.
11 (b) As used in this section, the term "minority business"
12 means a minority business enterprise as defined in the act of
13 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
14 Minority Business Development Authority Act.
15 Section 1895. Appropriation of funds from miscellaneous
16 sources.--(a) In addition to the amounts appropriated by this
17 part, moneys received in payment for food and household supplies
18 furnished to employees and other persons, except inmates, by an
19 institution, and moneys received from the proceeds from the sale
20 of any products of the soil, meats, livestock, timber or other
21 materials sold by the department shall be paid into the General
22 Fund and are hereby appropriated out of the General Fund to the
23 several respective institutions for the operation and
24 maintenance of the institutions.
25 (b) In addition to the amounts appropriated by this part,
26 all moneys received from any other source, except the Federal
27 Government, as contributions for the programs provided herein or
28 as payment for services or materials furnished by one
29 institution to another, except those collections designated as
30 revenues, shall be paid into the General Fund and are hereby

2 respective appropriations.
3 (c) In addition to any funds specifically appropriated by

8 this part shall be paid into the General Fund and credited to
9 the appropriation for that program or administration of the act.
10 Section 1896. Lapsing of unused funds.--(a) Except as
11 otherwise provided by law or by this section, that part of all
12 appropriations in Part XVIII unexpended, uncommitted or
13 unencumbered as of June 30, 2004, shall automatically lapse as
14 of that date.
15 (b) The appropriation in section 209 of Part II of the act
16 of December 23, 2003 (P.L. , No.9A), known as the First
17 Supplemental General Appropriation Act of 2003, to the
18 Department of Community and Economic Development for the
19 prevention of military base realignment and closure shall be a
20 continuing appropriation until June 30, 2006.
21 Section 1897. Construction with prior appropriation acts.--
22 Any appropriation in Subpart B of this part which is the same or
23 similar to any appropriation in the act of March 20, 2003 (P.L.
24 , No.1A), known as the General Appropriation Act of 2003, or
25 the act of December 23, 2003 (P.L. , No.9A), known as the
26 First Supplemental General Appropriation Act of 2003, shall
27 replace that appropriation.
28 Section 1898. Deduction of expended appropriations under
29 prior law.--Any money which has been appropriated and expended
30 under the act of March 20, 2003 (P.L. , No.1A), known as the

1 General Appropriation Act of 2003, or the act of December 23,
2 2003 (P.L. , No.9A), known as the First Supplemental General
3 Appropriation Act of 2003, shall be deducted from the
4 corresponding appropriation in this part.
5 PART XIX
6 SPECIAL PROVISIONS FOR FEDERAL FUNDS
7 FOR 2004-2005
8 Section 1901. General Fund repository for Federal funds.--
9 All moneys received from the Federal Government as contributions
10 or supplements to the departments or agencies of the
11 Commonwealth or the programs herein provided shall be paid into
12 the General Fund.
13 Section 1902. Limitation on encumbering or spending Federal
14 funds.--Federal funds shall be encumbered or spent only to the
15 extent that such funds are estimated as being available during
16 the fiscal year of the Commonwealth.
17 Section 1903. Appropriation of prior unspent Federal
18 funds.--Any Federal money which has been previously appropriated
19 by the General Assembly and authorized or allocated by the
20 Federal Government but remains unspent from prior fiscal years
21 and will not be renewed for fiscal year 2004-2005 is hereby
22 appropriated.
23 Section 1904. Subgrants between Federal fund
24 appropriations.--Subgrants may be made between appropriations
25 without further approval of the General Assembly. The Secretary
26 of the Budget shall submit a list of subgrants to the chairman
27 and minority chairman of the Appropriations Committee of the
28 Senate and the chairman and minority chairman of the
29 Appropriations Committee of the House of Representatives
30 quarterly. No subgrant to a State agency, however, may be made

1 from a restricted receipt account without a specific
2 appropriation by the General Assembly.
3 Section 1905. Utilization of emergency Federal funds.--(a)
4 Federal funds available for costs and damages resulting from
5 natural disasters or civil disobedience may be added to an
6 appropriation contained in this act or to funds appropriated or
7 may be used for the purposes prescribed by the Federal
8 Government.
9 (b) In addition to the moneys appropriated by this act, all
10 moneys received from the Federal Government for the purpose of
11 disaster assistance or relief, or other moneys received as a
12 direct result of terrorist acts and moneys for homeland security
13 and defense, shall be paid into the General Fund and are hereby
14 appropriated out of the General Fund to the departments, boards,
15 commissions or agencies designated by the Governor.
16 (c) In the event of any emergency situation in which the
17 General Assembly cannot act in sufficient time, the Governor is
18 authorized through executive authorization to provide up to
19 $10,000,000 in Federal funds to alleviate the emergency
20 situation. For the purposes of this section, "emergency" is
21 defined as any situation in which there is a chance of or which
22 may result in substantial human suffering.
23 Section 1906. Transfer of funds from TANFBG to CCDFBG and
24 SSBG.--In accordance with Federal law which permits the transfer
25 of funds from the TANFBG to the CCDFBG and SSBG, the Department
26 of Public Welfare, upon approval of the Secretary of the Budget,
27 may make such transfers of funds provided that any such transfer
28 will not result in a deficit in any appropriation from which
29 funds are transferred. The Secretary of the Budget shall provide
30 ten days prior notification of any such transfers to the

1 chairman and the minority chairman of the Appropriations
2 Committee of the Senate and the chairman and minority chairman
3 of the Appropriations Committee of the House of Representatives.
4 Section 1907. Transfer of LIHEAP funds.--(a) The Department
5 of Public Welfare, upon approval of the Secretary of the Budget,
6 may transfer up to 15% of any additional funds received for the
7 LIHEAP program either through an increase in the regular program
8 or a Presidential release of contingency funds, to the
9 Department of Community and Economic Development for the LIHEAP
10 - Weatherization Program. The Secretary of the Budget shall
11 provide ten days prior notification of any such transfers to the
12 chairman and minority chairman of the Appropriations Committee
13 of the Senate and the chairman and minority chairman of the
14 Appropriations Committee of the House of Representatives.
15 (b) The Department of Public Welfare, upon approval of the
16 Secretary of the Budget, may transfer LIHEAP administrative
17 funds to the Department of Community and Economic Development
18 subject to any limitations under Federal law. The Secretary of
19 the Budget shall provide ten days prior notification of any such
20 transfer to the chairman and minority chairman of the
21 Appropriations Committee of the Senate and the chairman and
22 minority chairman of the Appropriations Committee of the House
23 of Representatives.
24 PART XX
25 MISCELLANEOUS PROVISIONS FOR 2004-2005
26 Section 2001. Prior laws unaffected.--Except as provided in
27 section 253, this act is not intended to be inconsistent with or
28 to repeal any provision of any act enacted at this or any prior
29 session of the General Assembly regulating the purchase of
30 supplies, the ordering of printing and binding, the purchase,

1 maintenance and use of automobiles, the method of making
2 payments from the State Treasury for any purpose or the
3 functioning of any administrative department, board or
4 commission.
5 Section 2002. Compliance with other law before funds
6 available.--No appropriation made by this act to any department,
7 board, commission or agency of the Executive Department shall be
8 available unless and until the department, board, commission or
9 agency has complied with sections 615 and 616 of the act of
10 April 9, 1929 (P.L.177, No.175), known as The Administrative
11 Code of 1929.
12 Section 2003. Contracts prerequisite to encumbering or
13 committing funds.--Funds available to agencies, boards,
14 departments, commissions, or other governmental entities under
15 this act for the procurement of supplies, services or
16 construction shall not be available for payment of, or to be
17 committed to or encumbered for payment of, any such procurement
18 unless and until the agency, board, department or other
19 governmental entity has complied with all of the requirements
20 applicable to the procurement that are set out in 62 Pa.C.S.
21 (relating to procurement) and in the policies, procedures and
22 regulations instituted in accordance with that code.
23 Section 2004. Minority business set-asides.--(a) Each
24 department or other instrumentality of the Commonwealth listed
25 in Subpart A of Part II authorized to contract for buildings,
26 highways, commodities, equipment, supplies or services shall
27 report to the General Assembly all information pertinent to
28 anticipated procurement needs at the beginning of each fiscal
29 year and each fiscal quarter thereafter.
30 (b) As used in this section, the term "minority business"

1 means a minority business enterprise as defined in the act of
2 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania
3 Minority Business Development Authority Act.
4 Section 2005. Appropriation of funds from miscellaneous
5 sources.--(a) In addition to the amounts appropriated by this
6 act, moneys received in payment for food and household supplies
7 furnished to employees and other persons, except inmates, by an
8 institution, and moneys received from the proceeds from the sale
9 of any products of the soil, meats, livestock, timber or other
10 materials sold by the department shall be paid into the General
11 Fund and are hereby appropriated out of the General Fund to the
12 several respective institutions for the operation and
13 maintenance of the institutions.
14 (b) In addition to the amounts appropriated by this act, all
15 moneys received from any other source, except the Federal
16 Government, as contributions for the programs provided herein or
17 as payment for services or materials furnished by one
18 institution to another, except those collections designated as
19 revenues, shall be paid into the General Fund and are hereby
20 appropriated out of the General Fund for the purposes of the
21 respective appropriations.
22 (c) In addition to any funds specifically appropriated by
23 this act, all moneys received by a department or agency of the
24 Commonwealth from any other sources, except the Federal
25 Government, as contributions or supplements to the department or
26 agency for a program or administration of an act included in
27 this act shall be paid into the General Fund and credited to the
28 appropriation for that program or administration of the act.
29 Section 2006. Lapsing of unused funds.--(a) Except as
30 otherwise provided by law or by this section, that part of all

1 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X,
2 XI, XII, XIII, XIV, XV, XVI and XVI-A unexpended, uncommitted or
3 unencumbered as of June 30, 2005, shall automatically lapse as
4 of that date.
5 (b) The appropriation in Part II to the Department of
6 Community and Economic Development for the prevention of base
7 realignment and closure shall be a continuing appropriation
8 until June 30, 2006.
9 (c) The appropriation in Part II to the Department of
10 General Services for printing of the Pennsylvania Manual shall
11 be a continuing appropriation until June 30, 2006.
12 (d) The appropriations in Part II to the Legislative
13 Department shall be continuing appropriations.
14 Section 2007. Appellate courts appropriation contingency.--
15 The funds appropriated in Part II to the Supreme, Superior and
16 Commonwealth Courts for justice and judge expenses are
17 contingent upon a vouchered expense account plan being continued
18 by the Supreme Court.
19 Section 2008. Transfer of excess funds.--The Governor may
20 transfer any excess money in those funds receiving proceeds of
21 Commonwealth of Pennsylvania general obligation bonds in excess
22 of the amount necessary for the purposes for which the bonds
23 were issued to the appropriate sinking fund for payment of debt
24 service due on outstanding bonds. If such excess funds, together
25 with any available balance, exceed the amount of debt service
26 remaining to be paid, the funds shall be transferred to the
27 General Fund or to the appropriate special fund responsible for
28 such debt service.
29 Section 2009. Transfer of funds by the Supreme Court.--The
30 Supreme Court may transfer during the fiscal year funds

1 appropriated in sections 281, 282, 283, 284, 285, 286, 287, 290
2 and 291 of the act of March 20, 2003 (P.L. , No.1A), known as
3 the General Appropriation Act of 2003, or this act, among any of
4 the line items contained within those sections. After making
5 such transfers, including any transfers that may be necessary to
6 avoid a deficit in any line items in these sections, the Supreme
7 Court may also transfer any excess funds appropriated in these
8 sections to the Judicial Computer System Augmentation Account
9 during the month of June 2004. No transfer may create or
10 increase a deficiency in the appropriation from which the
11 transfer is made. Whenever the Supreme Court makes a transfer
12 under this subsection, the Supreme Court shall give written
13 notification to the Secretary of the Budget and chairman and
14 minority chairman of the Senate Committee on Appropriations and
15 the chairman and the minority chairman of the House of
16 Representatives Committee on Appropriations ten days prior to
17 any transfer. The written notice shall also include
18 certification that such transfer will not result in a deficit in
19 any appropriation.
20 Section 2010. Transfer from Hazardous Sites Cleanup Fund.--
21 The sum of $8,000,000 is transferred from the Hazardous Sites
22 Cleanup Fund to the Industrial Sites Cleanup Fund.
23 PART XXI
24 EFFECTIVE DATE
25 Section 2101. Effective date.--This act shall take effect as
26 follows:
27 (1) Part XVIII shall take effect immediately.
28 (2) This section shall take effect immediately.
29 (3) The remainder of this act shall take effect July 1,
30 2004, or immediately, whichever is later.
