                                     AN ACT

     1  Amending the act of November 10, 1999 (P.L.491, No.45), entitled
     2     "An act establishing a uniform construction code; imposing
     3     powers and duties on municipalities and the Department of
     4     Labor and Industry; providing for enforcement; imposing
     5     penalties; and making repeals," further providing for
     6     penalties.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 903 of the act of November 10, 1999
    10  (P.L.491, No.45), known as the Pennsylvania Construction Code
    11  Act, is amended to read:
    12  Section 903.  Penalties.
    13     (a)  Violation of act.--Except as otherwise provided under
    14  subsection (c):
    15         (1)  Any individual, firm or corporation that violates
    16     any provision of this act commits a summary offense and
    17     shall, upon conviction, be sentenced to pay a fine of not
    18     more than $1,000 and costs.
    19         (2)  Each day that a violation of this act continues


     1     shall be considered a separate violation.
     2     (b)  Disposition of penalties.--The amount of the penalty
     3  shall be forwarded to the entity with enforcement jurisdiction.
     4     (c)  First time offense involving residential property.--If
     5  any individual, firm or corporation violates any provision of
     6  this act as a first violation and the violation involves a
     7  repair or improvement to residential property that does not
     8  exceed $5,000 and does not threaten public health or safety, the
     9  individual, firm or corporation shall, upon conviction, receive
    10  a warning notice indicating the amount of fines that may be
    11  imposed for any subsequent violation of this act.
    12     Section 2.  This act shall take effect in 60 days.
