                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for restitution.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The definitions of "restitution" and "victim" in
     6  section 1106(h) of Title 18 of the Pennsylvania Consolidated
     7  Statutes are amended to read:
     8  § 1106.  Restitution for injuries to person or property.
     9     * * *
    10     (h)  Definitions.--As used in this section, the following
    11  words and phrases shall have the meanings given to them in this
    12  subsection:

    14     "Restitution."  The return of the property of the victim or
    15  payments in cash or the equivalent thereof pursuant to an order


     1  of the court. The term includes reimbursement of a public agency
     2  for the cost of any undercover buy money expense.
     3     "Victim."  As defined in section 479.1 of the act of April 9,
     4  1929 (P.L.177, No.175), known as The Administrative Code of
     5  1929. The term includes [the]:
     6         (1)  The Crime Victim's Compensation Fund if compensation
     7     has been paid by the Crime Victim's Compensation Fund to the
     8     victim [and any].
     9         (2) Any insurance company that has compensated the victim
    10     for loss under an insurance contract.
    11         (3)  A public agency that has not recovered undercover
    12     buy money used in connection with the crime for which the
    13     offender is being sentenced.
    14     Section 2.  This act shall take effect in 60 days.
