AN ACT
1 Amending Title 23 (Domestic Relations) of the Pennsylvania
2 Consolidated Statutes, further providing for when
3 grandparents may petition.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Section 5313(a) of Title 23 of the Pennsylvania
7 Consolidated Statutes is amended to read:
8 § 5313. When grandparents may petition.
9 (a) Partial custody and visitation.--If an unmarried child
10 has resided with his grandparents or great-grandparents [for a
11 period of 12 months or more] and is subsequently removed from
12 the home by his parents, the grandparents or great-grandparents
13 may petition the court for an order granting them reasonable
14 partial custody or visitation rights, or both, to the child. The
15 court shall grant the petition if it finds that visitation
16 rights would be in the best interest of the child and would not
17 interfere with the parent-child relationship.
