                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, providing for a Fight Terrorism registration plate;
     3     and establishing the Flight 93 Memorial Fund.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 1361.  Fight Terrorism registration plate.
     9     (a)  Design.--The department shall design a special Fight
    10  Terrorism registration plate. The design shall include the
    11  following elements:
    12         (1)  A pentagon-shaped symbol which serves as a border.
    13         (2)  The terms "Fight Terrorism," "New York, N.Y.,"
    14     "Arlington, VA" and "Somerset, PA" on the outside of the
    15     border.
    16         (3)  The date "9-11-01" with the number 11 represented by

     1     a likeness of the World Trade Center buildings.
     2         (4)  A depiction of the American flag.
     3     (b)  Issuance.--Upon application of any person, accompanied
     4  by a fee of $35 which shall be in addition to the annual
     5  registration fee, the department shall issue the plate under
     6  subsection (a) for a passenger car, motor home, trailer or truck
     7  with a gross vehicle weight rating of not more than 9,000
     8  pounds. The Flight 93 Memorial Fund shall receive $15 of each
     9  additional fee for this plate.
    10     Section 2.  Section 1905 of Title 75 is amended by adding a
    11  subsection to read:
    12  § 1905.  Payments to special funds.
    13     * * *
    14     (d)  Flight 93 Memorial Fund.--Fifteen dollars of each fee
    15  collected under section 1361 (relating to Fight Terrorism
    16  registration plate) shall be credited to the Flight 93 Memorial
    17  Fund, established as follows:
    18         (1)  There is hereby established a special account in the
    19     State Treasury which shall be known as the Flight 93 Memorial
    20     Fund. The purpose of the Flight 93 Memorial Fund is to
    21     provide moneys for:
    22             (i)  The construction, operation and maintenance of a
    23         physical monument, to be located in Somerset County on or
    24         near the site where Flight 93 crashed on September 11,
    25         2001, to memorialize and honor the innocent victims who
    26         died aboard Flight 93.
    27             (ii)  Costs associated with operating and maintaining
    28         the monument site, including any programs conducted at
    29         the site for purposes of commemorating the victims of
    30         Flight 93 or for related educational or patriotic

     1         purposes.
     2         (2)  All moneys in the Flight 93 Memorial Fund are hereby
     3     annually appropriated on a continuing basis to the Department
     4     of General Services and may be expended for the purposes
     5     authorized under this subsection.
     6         (3)  Estimates of amounts to be expended under this
     7     subsection shall be submitted to the Governor by the
     8     Department of General Services for the Governor's approval.
     9         (4)  The State Treasurer shall not honor any requisition
    10     for expenditures by the Department of General Services in
    11     excess of estimates approved by the Governor or in excess of
    12     the amount available for the purposes for which the
    13     requisition was made, whichever is the lesser amount.
    14     Section 3.  This act shall take effect in 60 days.
