AN ACT 1 Providing for the duties of the Pennsylvania State Police 2 regarding criminal history background reports for persons 3 participating in harness or horse racing. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Criminal history background reports. 7 (a) Duty to provide.--The Pennsylvania State Police shall, 8 at the request of the State Harness Racing Commission or the 9 State Horse Racing Commission, provide criminal history 10 background reports, which shall include records of criminal 11 arrests or convictions, on applicants for licensure by the 12 respective commission pursuant to section 213 of the act of 13 December 17, 1981 (P.L.435, No.135), known as the Race Horse 14 Industry Reform Act, including, but not limited to, officers, 15 directors and stockholders of licensed corporations, horse 16 owners, trainers, jockeys, drivers and other persons 17 participating in thoroughbred or harness horse meetings and 18 other persons and vendors who exercise their occupation or
1 employment at such meetings. 2 (b) Submittal of fingerprints.--Applicants to the State 3 Harness Racing Commission and the State Horse Racing Commission 4 shall submit a full set of their fingerprints which shall be 5 forwarded by the respective commission to the Pennsylvania State 6 Police for the purpose of verifying the identity of the 7 applicants and facilitating the preparation of criminal history 8 background reports under subsection (a). 9 (c) Exemption.--The State Harness Racing Commission and the 10 State Horse Racing Commission may exempt applicants for 11 positions not related to the care or training of horses, racing, 12 wagering, security or the management of licensed corporations 13 from the provisions of this act. 14 Section 2.
