AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," further providing for 21 collective bargaining in education; and making a repeal. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Section 1321(a) of the act of April 9, 1929 25 (P.L.177, No.175), known as The Administrative Code of 1929, 26 amended November 26, 1997 (P.L.530, No.57), is amended to read: 27 Section 1321. Collective Bargaining.--(a) School
1 administrators employed by a city of the first class shall, 2 through labor organizations or other representatives designated 3 by fifty per centum (50%) or more of such school administrators, 4 have the right to bargain collectively with their public 5 employers concerning the terms and conditions of their 6 employment, including compensation, hours, working conditions 7 and other benefits, and shall have the right to an adjustment or 8 settlement of their grievances or disputes in accordance with 9 the terms of this section. The Pennsylvania Labor Relations 10 Board shall resolve disputes as to the items under this 11 subsection in the same manner as it resolves disputes under the 12 act of July 23, 1970 (P.L.563, No.195), known as the "Public 13 Employe Relations Act." 14 * * * 15 Section 2. Section 8 of the act of July 11, 1996 (P.L.619, 16 No.105), entitled "An act amending the act of April 9, 1929 17 (P.L.177, No.175), entitled 'An act providing for and 18 reorganizing the conduct of the executive and administrative 19 work of the Commonwealth by the Executive Department thereof and 20 the administrative departments, boards, commissions, and 21 officers thereof, including the boards of trustees of State 22 Normal Schools, or Teachers Colleges; abolishing, creating, 23 reorganizing or authorizing the reorganization of certain 24 administrative departments, boards, and commissions; defining 25 the powers and duties of the Governor and other executive and 26 administrative officers, and of the several administrative 27 departments, boards, commissions, and officers; fixing the 28 salaries of the Governor, Lieutenant Governor, and certain other 29 executive and administrative officers; providing for the 30 appointment of certain administrative officers, and of all 20030H2251B3080 - 2 -
1 deputies and other assistants and employes in certain 2 departments, boards, and commissions; and prescribing the manner 3 in which the number and compensation of the deputies and all 4 other assistants and employes of certain departments, boards and 5 commissions shall be determined,' transferring the Scotland 6 School for Veterans' Children from the Department of Education 7 to the Department of Military and Veterans Affairs; providing 8 for a Pennsylvania Historical and Museum Commission volunteer 9 program; further providing for the Aviation Restricted Account; 10 specifically authorizing collective bargaining between school 11 administrators in school districts of the first class and their 12 public employers; providing for arbitration in order to settle 13 disputes; requiring compliance with collective bargaining 14 agreements and findings of arbitrators; providing for pay to 15 certain inspectors, for contribution to Korea/Vietnam Memorial 16 National Education Center and for an exclusion from sales and 17 use tax; making repeals; and making editorial changes," is 18 repealed. 19 Section 3.
