AN ACT 1 Amending the act of April 12, 1951 (P.L.90, No.21), entitled, as 2 reenacted, "An act relating to alcoholic liquors, alcohol and 3 malt and brewed beverages; amending, revising, consolidating 4 and changing the laws relating thereto; regulating and 5 restricting the manufacture, purchase, sale, possession, 6 consumption, importation, transportation, furnishing, holding 7 in bond, holding in storage, traffic in and use of alcoholic 8 liquors, alcohol and malt and brewed beverages and the 9 persons engaged or employed therein; defining the powers and 10 duties of the Pennsylvania Liquor Control Board; providing 11 for the establishment and operation of State liquor stores, 12 for the payment of certain license fees to the respective 13 municipalities and townships, for the abatement of certain 14 nuisances and, in certain cases, for search and seizure 15 without warrant; prescribing penalties and forfeitures; 16 providing for local option, and repealing existing laws," 17 providing for a Pennsylvania products license. 18 The General Assembly of the Commonwealth of Pennsylvania 19 hereby enacts as follows: 20 Section 1. The act of April 12, 1951 (P.L.90, No.21), known 21 as the Liquor Code, reenacted and amended June 29, 1987 (P.L.32, 22 No.14), is amended by adding a section to read: 23 Section 415. Pennsylvania Products License.--(a) The board 24 is authorized to issue a restaurant liquor license to any 25 restaurant in a municipality with a population of ten thousand
1 or fewer persons that is in the same county as a municipality 2 with a population of thirty thousand or more persons for the 3 sale of only liquor and malt or brewed beverages distilled, 4 brewed or otherwise produced in Pennsylvania. The population of 5 a municipality shall be determined by the last preceding United 6 States decennial census. 7 (b) Licenses issued under this section shall be considered 8 restaurant liquor licenses and shall be subject to: 9 (1) the licensing period as set forth by the board under 10 section 402; 11 (2) the application provisions of section 403; 12 (3) the issuance provisions of section 404; 13 (4) the sales restrictions of section 406; and 14 (5) application, renewal and filing fees as prescribed in 15 section 614-A of the act of April 9, 1929 (P.L.177, No.175), 16 known as "The Administrative Code of 1929." 17 Licenses issued under this section shall not be subject to the 18 quota restrictions of section 461. 19 (c) Licenses issued under this section shall expire upon: 20 (1) revocation by an administrative law judge under section 21 471; 22 (2) nonrenewal by the board under section 470; or 23 (3) nonrenewal of the license by the license holder. 24 Section 2.
