                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, further providing for duties of
     3     electric distribution companies.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 2807(a) of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended and the section is amended by
     8  adding a subsection to read:
     9  § 2807.  Duties of electric distribution companies.
    10     (a)  General rule.--Each electric distribution company shall
    11  maintain the integrity of the distribution system at least in
    12  conformity with the National Electric Safety Code and such other
    13  standards practiced by the industry in a manner sufficient to
    14  provide safe and reliable service to all customers connected to
    15  the system consistent with this title and the commission's
    16  regulations. In performing such duties, the electric
    17  distribution company shall implement procedures to require all


     1  electric generation suppliers to deliver energy to the electric
     2  distribution company at locations and in amounts which are
     3  adequate to meet the energy supplier's obligations to its
     4  customers. [Subject to commission approval, the electric
     5  distribution company may require that the customer install, at
     6  the customer's expense, enhanced metering capability sufficient
     7  to match the energy delivered by the electric generation
     8  suppliers with consumption by the customer.]
     9     * * *
    10     (f)  Advanced metering and demand response programs.--
    11         (1)  On or before January 1, 2005, each jurisdictional
    12     electric distribution company shall file a plan for
    13     commission approval to provide the physical and informational
    14     infrastructure that enables all customers to participate in
    15     demand response programs offered by default providers and
    16     competitive electric generation suppliers. The program shall:
    17             (i)  Provide a plan to install advanced metering that
    18         enables a customer and/or his supplier to configure usage
    19         and obtain readings at least on an hourly interval. Such
    20         advanced metering shall be available to all customers so
    21         requesting as of January 1, 2006, and to all customers on
    22         or before the end of the rate cap for the electric
    23         distribution utility pursuant to section 2804(4)
    24         (relating to standards for restructuring of electric
    25         industry).
    26             (ii)  Provide an open information architecture such
    27         that a customer may participate in a demand response
    28         program offered by any default or competitive supplier on
    29         comparable terms.
    30             (iii)  Allow the actual meter reads to be used for

     1         all billing purposes and not require any average class
     2         load profile to be used.
     3             (iv)  Provide a demand side response program offered
     4         by the electric distribution company or its default
     5         suppliers that:
     6                 (A)  Is available to all customers but does not
     7             mandate the participation of any customer.
     8                 (B)  Includes appliance control technologies and
     9             time of use rates.
    10                 (C)  Has a program design, administrative cost
    11             and participation rate that maximizes cost-effective
    12             participation by reducing the cost of default supply
    13             during peak load to the participating customer, to
    14             the default customers of the electric distribution
    15             company as a whole, and to the consumers served by
    16             the same wholesale electricity market.
    17         (2)  The commission shall review the demand response and
    18     advanced metering plan filed, and shall, after the
    19     opportunity for all interested parties to file comments and
    20     reply comments, adopt a plan within six months that accepts,
    21     rejects or modifies the plan filed as necessary and
    22     appropriate to maximize the avoidance of peak generation and
    23     its costs, consistent with the requirements of this section.
    24     Section 2.  This act shall take effect immediately.
