HOUSE BILL

        INTRODUCED BY JAMES, WATERS, MANDERINO, MELIO, WHEATLEY,
           WASHINGTON, LEDERER, SOLOBAY, KIRKLAND, GEORGE, YOUNGBLOOD,
           THOMAS, JOSEPHS, BELARDI, DALEY, WILLIAMS, BLAUM, CRAHALLA,
           DeLUCA AND MYERS, JUNE 25, 2003

                                     AN ACT

     1  Establishing the Pennsylvania Uniform Crime Reporting Program;
     2     requiring all county and municipal law enforcement agencies
     3     to report certain information occurring within the respective
     4     jurisdictions; and authorizing the Pennsylvania State Police
     5     to collect and gather information on crime and make annual
     6     reports.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9  Section 1.  Short title.
    10     This act shall be known and may be cited as the Pennsylvania
    11  Uniform Crime Reporting Act.
    12  Section 2.  Definitions.
    13     The following words and phrases when used in this act shall
    14  have the meanings given to them in this section unless the
    15  context clearly indicates otherwise:
    16     "Program."  The Pennsylvania Uniform Crime Reporting Program
    17  established by this act to provide a Statewide view of crime
    18  trends and volume based on the contribution of statistics by law
    19  enforcement agencies throughout this Commonwealth.

     1     "State, county and local law enforcement agencies."  The
     2  Pennsylvania State Police and any city, borough, town, township
     3  or county police agency or organization that possesses general
     4  police powers and is charged with making arrests in connection
     5  with the enforcement of criminal or traffic laws and employs law
     6  enforcement officers duly certified under the former act of June
     7  18, 1974 (P.L.359, No.120), referred to as the Municipal Police
     8  Education and Training Law, or 53 Pa.C.S. Ch. 21 Subch. D
     9  (relating to municipal police education and training).
    10     "System" or "PAUCRS."  A World Wide Web-based data collection
    11  and dissemination system used to facilitate operation of the
    12  Pennsylvania Uniform Crime Reporting Program.
    13  Section 3.  Establishment of Pennsylvania Uniform Crime
    14                 Reporting Program.
    15     The Pennsylvania Uniform Crime Reporting Program is
    16  established under the direction, control and supervision of the
    17  Pennsylvania State Police. The Pennsylvania State Police shall,
    18  by such rules and regulations as the Pennsylvania State Police
    19  may deem necessary, collect and gather the information from
    20  State, county and local law enforcement agencies as may be
    21  prescribed in this act. The program shall include a procedure
    22  for notifying county and local law enforcement agencies that are
    23  not compliant with their reporting requirements that they are
    24  ineligible to receive any portion of fines collected and
    25  distributed under 42 Pa.C.S. Ch. 35, Subch. E (relating to
    26  fines, etc.) or any grant administered by the Pennsylvania
    27  Commission on Crime and Delinquency.
    28  Section 4.  Monthly contribution.
    29     All State, county and local law enforcement agencies shall
    30  contribute statistical information related to number and nature

     1  of offenses occurring within their respective jurisdictions, the
     2  disposition of such matters, and such other related information
     3  as the Pennsylvania State Police may require. Such contributions
     4  shall be consistent with established program guidelines, in a
     5  manner as prescribed by the Pennsylvania State Police, and shall
     6  reflect monthly increments.
     7  Section 5.  Compilation of statistics.
     8     Upon receipt of the information, the Pennsylvania State
     9  Police shall have such data collated and formulated and shall
    10  compile such statistics as the Pennsylvania State Police may
    11  deem necessary to present a proper depiction of the nature and
    12  volume of crime within this Commonwealth.
    13  Section 6.  Annual report.
    14     The Pennsylvania State Police shall electronically publish an
    15  annual report containing results of the information gathered and
    16  collated for access by the Governor, the General Assembly, the
    17  Attorney General and the public through the system.
    18  Section 7.  Dissemination of law enforcement agency information.
    19     Annually, or at intervals as requested by the Pennsylvania
    20  State Police, the Municipal Police Officers' Education and
    21  Training Commission shall provide the Pennsylvania State Police
    22  with information related to those Pennsylvania law enforcement
    23  agencies known to be in existence. Such information shall be
    24  correlated with program data on file to identify law enforcement
    25  agencies with incomplete data. A listing of such law enforcement
    26  agencies shall be included in the annual report. A current
    27  listing of such agencies shall also be made available for timely
    28  public access through the output reporting capabilities of the
    29  system.
    30  Section 8.  Repeal.

     1     All acts and parts of acts are repealed insofar as they are
     2  inconsistent with this act.
     3  Section 9.  Implementation.
     4     Implementation of the provisions of this act by the
     5  Pennsylvania State Police is contingent upon the availability of
     6  funding to facilitate changes as may be required in the program
     7  and the system.
     8  Section 10.  Effective date.
     9     This act shall take effect in 60 days.
