                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, defining "biometrics," "fingerprint imaging" and
     3     "smart card technology"; and further providing for issuance
     4     and content of driver's license and for commercial driver's
     5     license.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 102 of Title 75 of the Pennsylvania
     9  Consolidated Statutes is amended by adding definitions to read:
    10  § 102.  Definitions.
    11     Subject to additional definitions contained in subsequent
    12  provisions of this title which are applicable to specific
    13  provisions of this title, the following words and phrases when
    14  used in this title shall have, unless the context clearly
    15  indicates otherwise, the meanings given to them in this section:
    16     * * *
    17     "Biometrics."  The science and technology for measuring and
    18  analyzing human body characteristics, including, but not limited

     1  to, fingerprints, eye retinas and irises, voice patterns, facial
     2  patterns or hand measurements for the purpose of personal
     3  identity authentication.
     4     * * *
     5     "Fingerprint imaging."  A biometric process by which
     6  fingerprints are scanned, identifying features (minutiae) are
     7  extracted and measurements of the minutiae points relative to
     8  each other are mapped for comparison.
     9     * * *
    10     "Smart card technology."  A small electronic device that
    11  contains electronic memory on an embedded integrated circuit.
    12     * * *
    13     Section 2.  Section 1510(a) and (b) of Title 75 are amended
    14  and the section is amended by adding subsections to read:
    15  § 1510.  Issuance and content of driver's license.
    16     (a)  General rule.--The department shall, upon payment of the
    17  required fee, issue to every qualified applicant a driver's
    18  license [indicating the type or general class of vehicles the
    19  licensee is authorized to drive and any endorsements or
    20  restrictions, which license shall contain a distinguishing
    21  number assigned by the department to the licensee, the actual
    22  name, date of birth, residence address, a color photograph or
    23  photographic facsimile of the licensee, such other information
    24  as may be required by the department, and either a facsimile of
    25  the signature of the licensee or a space upon which the licensee
    26  shall write his usual signature with pen and ink.] which
    27  complies with the requirements of subsections (a.1), (a.2) and
    28  this subsection. The driver's license shall be designed and
    29  manufactured utilizing smart card technology which utilizes a
    30  departmental managed smart card technology data base to retrieve

     1  the pertinent information under subsections (a.1) and (a.2).
     2  Personal medical data and other information for use in an
     3  emergency may be included as a part of the license. Information
     4  other than that required to identify the licensee, the
     5  distinguishing number and the class of license issued may be
     6  included in microdata form. Except as provided in subsection
     7  (f), an applicant shall include his Social Security number on
     8  his license application[, but the Social Security number shall
     9  not be included on the license]. No driver's license shall be
    10  valid until it has been signed by the licensee.
    11     (a.1)  Visual information on license.--A driver's license
    12  issued under subsection (a) shall contain in visual format all
    13  of the following:
    14         (1)  A distinguishing number assigned by the department
    15     to the licensee.
    16         (2)  A color photograph or photographic facsimile of the
    17     licensee.
    18         (3)  The actual name of the licensee in printed form.
    19         (4)  A facsimile of the signature of the licensee.
    20         (5)  The expiration date of the license.
    21         (6)  Any other information the department deems
    22     necessary.
    23     (a.2)  Information stored by smart card technology.--The
    24  smart card technology required under this section shall be
    25  capable of storing in a secure manner all of the following
    26  information:
    27         (1)  A distinguishing number assigned by the department
    28     to the licensee.
    29         (2)  The actual name of the licensee.
    30         (3)  The date of birth of the licensee.

     1         (4)  The residential address of the licensee.
     2         (5)  A physical description of the person, including sex,
     3     height and eye color.
     4         (6)  A facsimile of the signature of the licensee.
     5         (7)  Social Security number.
     6         (8)  Fingerprint image.
     7         (9)  The type or general class of vehicles the licensee
     8     is authorized to drive.
     9         (10)  Any restrictions or endorsements.
    10         (11)  The expiration date of the license.
    11         (12)  Any other information the department deems
    12     necessary.
    13     (b)  Identification card.--The department shall, upon payment
    14  of the required fee, issue an identification card to any person
    15  who has made application therefor in such manner as the
    16  department shall prescribe or whose driver's license has been
    17  surrendered to the department because of a suspension or
    18  revocation of an operating privilege under this or any other
    19  title. The identification card shall be designed and
    20  manufactured in the same manner and of the same components as a
    21  driver's license and shall have substantially the same content
    22  as a driver's license but shall clearly indicate that it is not
    23  a driver's license. Upon failure of any person to pass any
    24  examination required under section 1514 (relating to expiration
    25  and renewal of drivers' licenses), the department shall, where
    26  appropriate, issue a complimentary identification card as an
    27  expression of gratitude for years of safe driving. The card
    28  shall only be issued upon receipt of the person's driver's
    29  license.

     1     Section 3.  Section 1610(a) of Title 75 is amended to read:
     2  § 1610.  Commercial driver's license.
     3     (a)  Content of license.--The commercial driver's license
     4  shall indicate "commercial driver's license" or ["CDL"] "CDL,"
     5  shall comply with the design and manufacturer's standards under
     6  section 1510(a) and (a.1) (relating to issuance and content of
     7  driver's license) and the smart card technology requirements
     8  under section 1510(a.1) and (a.2) and shall include, but not be
     9  limited to, the [following information:
    10         (1)  The name and residential address of the person.
    11         (2)  The person's color photograph or photographic
    12     facsimile.
    13         (3)  A physical description of the person, including sex,
    14     height and eye color.
    15         (4)  Date of birth.
    16         (5)  The license number assigned by the department.
    17         (6)  The person's signature or a facsimile of that
    18     signature.
    19         (7)  The] class or type of commercial motor vehicle or
    20     vehicles which the person is authorized to drive, together
    21     with any endorsements or restrictions.

    23     Section 4.  The Department of Transportation shall provide a
    24  schedule to phase-in the new drivers' licenses over a four-year
    25  period which follows the expiration dates for drivers' licenses
    26  issued on and after January 1, 2005.
    27     Section 5.  This act shall take effect July 1, 2003, or
    28  immediately, whichever occurs later.
