AN ACT 1 Providing for funding for an education and training program for 2 municipal inspectors and for certain repairs to residential 3 structures; and making repeals. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the Municipal 8 Inspector Education and Training Program Act. 9 Section 2. Definitions. 10 The following words and phrases when used in this act shall 11 have the meanings given to them in this section unless the 12 context clearly indicates otherwise: 13 "Department." The Department of Community and Economic 14 Development of the Commonwealth. 15 "Minor repair." A nonstructural repair that costs $1,000 or 16 less or as otherwise defined by ordinance of a municipality 17 which has elected to enforce the act of November 10, 1999 18 (P.L.491, No.45), known as the Pennsylvania Construction Code
1 Act, pursuant to Chapter 5 of that act. 2 "Pennsylvania Construction Code Act." The act of November 3 10, 1999 (P.L.491, No.45), known as the Pennsylvania 4 Construction Code Act. 5 Section 3. Education and training fee. 6 (a) Fee.--Municipalities administering and enforcing the 7 Uniform Construction Code under section 501(a) of the 8 Pennsylvania Construction Code Act and third party agencies 9 providing services under section 501(e) of the Pennsylvania 10 Construction Code Act shall assess a fee of $2 on each 11 construction or building permit issued under the authority of 12 the Pennsylvania Construction Code Act. This fee shall be in 13 addition to any other fee imposed for the permit. 14 (b) Education and training programs.--The money collected as 15 authorized under subsection (a) shall be transmitted quarterly 16 to the Governor's Center for Local Government Services in the 17 department and placed in a restricted account to support the 18 Pennsylvania Construction Codes Academy for education and 19 training programs for municipal inspectors. 20 Section 4. Minor repairs. 21 A minor repair to a residential structure shall be exempt 22 from the provisions of the Pennsylvania Construction Code Act 23 and shall not require a permit from a municipality or a third- 24 party agency. 25 Section 5. Repeals. 26 (a) Absolute.--As much as reads "which provisions shall 27 continue in effect until December 31, 2003," in section 28 301(a)(6) of the act of November 10, 1999 (P.L.491, No.45), 29 known as the Pennsylvania Construction Code Act, is repealed. 30 (b) Inconsistent.--The act of November 10, 1999 (P.L.491, 20030H1654B2104 - 2 -
1 No.45), known as the Pennsylvania Construction Code Act, is 2 repealed insofar as it is inconsistent with this act. 3 Section 6. Effective date. 4 This act shall take effect 90 days following publication of 5 notice in the Pennsylvania Bulletin that the regulations 6 implementing the Pennsylvania Construction Code Act have been 7 finally adopted.
