AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, extending additional parking regulations to ex- 3 prisoners of war. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3354(d) and (e) of Title 75 of the 7 Pennsylvania Consolidated Statutes, amended October 4, 2002 8 (P.L.845, No.123), are amended to read: 9 § 3354. Additional parking regulations. 10 * * * 11 (d) Person with a disability and [disabled] certain 12 veterans.-- 13 (1) When a motor vehicle bearing a person with a 14 disability [or], severely disabled veteran or prisoner of war 15 plate or displaying a person with a disability [or], severely 16 disabled veteran or ex-prisoner of war parking placard as 17 prescribed in this title is being operated by or for the 18 transportation of the person with a disability or severely
1 disabled veteran or ex-prisoner of war, the driver shall be 2 relieved of any liability for parking for a period of 60 3 minutes in excess of the legal parking period permitted by 4 local authorities except where local ordinances or police 5 regulations provide for the accommodation of heavy traffic 6 during morning, afternoon or evening hours. 7 (2) At the request of a person with a disability [or], 8 severely disabled veteran or ex-prisoner of war, local 9 authorities may erect on the highway as close as possible to 10 the person's or veteran's place of residence a sign or signs 11 indicating that that place is reserved for a person with a 12 disability [or], severely disabled veteran or ex-prisoner of 13 war, that no parking is allowed there by others, and that any 14 unauthorized person parking there shall be subject to a fine 15 and may be towed. The absence of a sign stating the penalty 16 amount indicated in subsection (f) at parking spaces 17 designated with an international symbol for access for 18 persons with disabilities on a sign shall not preclude the 19 enforcement of this subsection. A vehicle may only be towed 20 under this paragraph if the parking space is posted with a 21 sign indicating that vehicles in violation of this section 22 may be towed. 23 (3) (i) Except for persons parking vehicles lawfully 24 bearing a person with a disability [or], severely 25 disabled veteran or prisoner of war registration plate or 26 displaying a person with a disability [or], severely 27 disabled veteran or ex-prisoner of war parking placard 28 when such vehicles are being operated by or for the 29 transportation of a person with a disability [or], a 30 severely disabled veteran or ex-prisoner of war, no 20030H1542B1949 - 2 -
1 person shall park a vehicle on public or private property 2 reserved for a person with a disability [or], severely 3 disabled veteran or ex-prisoner of war which property has 4 been so posted in accordance with departmental 5 regulations. Regulations shall require that parking 6 spaces designated with an international symbol for access 7 for persons with disabilities on a sign are posted with a 8 sign stating the penalty amount indicated in subsection 9 (f) and that vehicles in violation of the subsection may 10 be towed and require that signs be replaced when they 11 become either obsolete or missing with all costs to 12 replace the necessary signs to be borne by the persons 13 responsible for signing the particular location. The 14 absence of a sign stating the penalty amount at parking 15 spaces designated with an international symbol for access 16 for persons with disabilities shall not preclude the 17 enforcement of this subsection. A vehicle which is 18 unlawfully parked in a designated person with a 19 disability parking area may be removed from that area by 20 towing and may be reclaimed by the vehicle owner upon 21 payment of the towing costs. A vehicle may only be towed 22 under this paragraph if the parking space is posted with 23 a sign indicating that vehicles in violation of this 24 section may be towed. 25 (ii) Local authorities shall have the power and may, 26 by ordinance or resolution, authorize a person with a 27 disability [and], severely disabled veterans and ex- 28 prisoners of war to issue statements to violators or 29 violating vehicles for violation of subparagraph (i). The 30 form of the statement shall be as prescribed by the local 20030H1542B1949 - 3 -
1 authorities. 2 (iii) No occupancy or driveway permit may be issued 3 to a person whose property is reserved for a person with 4 a disability [or], a severely disabled veteran or ex- 5 prisoner of war if the property is not posted with a sign 6 stating the penalty amount indicated in subsection (f). 7 (e) Unauthorized use.--An operator of a vehicle bearing a 8 person with a disability [or], severely disabled veteran or ex- 9 prisoner of war plate or displaying a person with a disability 10 [or], severely disabled veteran or ex-prisoner of war parking 11 placard shall not make use of the parking privileges accorded to 12 a person with a disability [and], severely disabled veterans and 13 ex-prisoners of war under subsection (d)(3) unless the operator 14 is a person with a disability [or], a severely disabled veteran 15 or ex-prisoner of war or unless the vehicle is being operated 16 for the transportation of a person with a disability [or], 17 severely disabled veteran or ex-prisoner of war. 18 * * * 19 Section 2.
