AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for person with disability plate 3 or placard, for physical examinations and for the Medical 4 Advisory Board. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Sections 1338(c), 1508.1 and 1517(a) of Title 75 8 of the Pennsylvania Consolidated Statutes are amended to read: 9 § 1338. Person with disability plate and placard. 10 * * * 11 (c) [Physician's] Health care provider statement.-- 12 (1) Any person applying for a special plate or parking 13 placard for persons with disabilities must present a 14 statement, certified by a physician, chiropractor, physician 15 assistant or certified registered nurse practitioner licensed 16 to practice in this Commonwealth or in a contiguous state, 17 that the person with a disability is disabled as provided in 18 subsection (a).
1 (2) Any person applying for a renewal of registration of 2 a special plate for persons with disabilities must comply 3 with this subsection. Once a person with a disability has 4 been duly certified by a physician, chiropractor, physician 5 assistant or certified registered nurse practitioner as being 6 disabled, as provided in subsection (a), the applicant need 7 not submit a certification for subsequent renewals of 8 registration for a special plate for persons with 9 disabilities. A person who was issued a person with 10 disability plate under this section and no longer qualifies 11 for one shall not be charged a replacement fee for a regular 12 registration plate upon payment of the regular registration 13 fee. 14 (3) In lieu of a [physician's] health care provider's 15 statement, a person applying for a special plate or parking 16 placard may present a statement from a police officer 17 certifying that the person does not have full use of a leg, 18 or both legs, or is blind. 19 (4) The department shall phase out existing handicapped 20 placards as soon as practicable and issue a new series to 21 persons who comply with this section. 22 * * * 23 § 1508.1. Physical examinations. 24 The department shall promulgate regulations to authorize 25 specific classes of licensed practitioners of the healing arts, 26 to include, but not be limited to, physicians, chiropractors, 27 physician assistants and certified registered nurse 28 practitioners, to conduct examinations required for the issuance 29 of a driver's license and a school bus driver endorsement. 30 § 1517. Medical Advisory Board. 20030H1445B1801 - 2 -
1 (a) Membership.--There shall be a Medical Advisory Board 2 consisting of [13] 15 members appointed by the secretary. The 3 board shall be composed of an authorized representative from the 4 Department of Transportation, Department of Justice, Governor's 5 Council on Drug and Alcohol Abuse, Department of Health, 6 Pennsylvania State Police and professionals as follows: One 7 neurologist, one doctor of cardiovascular disease, one doctor of 8 internal medicine, one general practitioner, one 9 ophthalmologist, one psychiatrist, one orthopedic surgeon [and], 10 one optometrist, one chiropractor and one certified registered 11 nurse practitioner. 12 * * * 13 Section 2.
