THE GENERAL ASSEMBLY OF PENNSYLVANIA


HOUSE BILL

        AS AMENDED ON THIRD CONSIDERATION, IN SENATE, DECEMBER 19, 2003

                                     AN ACT

     1  Making an appropriation to the Philadelphia College of
     2     Osteopathic Medicine, Philadelphia.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5     Section 1.  The sum of $4,650,000 is hereby appropriated to
     6  the Philadelphia College of Osteopathic Medicine, Philadelphia,
     7  for the fiscal year July 1, 2003, to June 30, 2004, for
     8  instruction in the Doctor of Osteopathy program.
     9     Section 2.  Payments to the Philadelphia College of
    10  Osteopathic Medicine on account of the appropriation provided in
    11  section 1 shall be made quarterly by the Secretary of Education
    12  on the basis of costs during the fiscal year and shall be
    13  conditioned on continuing authority for inclusion on the Board
    14  of Trustees of the Philadelphia College of Osteopathic Medicine
    15  of a minimum of five persons who are not elected officials and
    16  who are appointed by the Governor, the President pro tempore of
    17  the Senate, the Minority Leader of the Senate, the Speaker of

     1  the House of Representatives and the Minority Leader of the
     2  House of Representatives for terms of office coterminous with
     3  that of the respective appointing authority; and shall be
     4  further conditioned on these appointees receiving full voting
     5  rights as members of the board of trustees.
     6     Section 3.  The Philadelphia College of Osteopathic Medicine
     7  shall provide full, complete and accurate information as may be
     8  required by the Department of Education or the chairman or the
     9  minority chairman of the Appropriations Committee of the Senate
    10  or the chairman or the minority chairman of the Appropriations
    11  Committee of the House of Representatives.
    12     Section 4.  The Philadelphia College of Osteopathic Medicine
    13  shall report its revenues and expenditures and present its
    14  financial statements in accordance with generally accepted
    15  accounting principles and procedures for educational
    16  institutions as set forth in the "Higher Education Finance
    17  Manual (1975)" and the "Commonwealth of Pennsylvania Budget
    18  Instructions for the State System of Higher Education, State-
    19  Related Universities and Non-State-Related Colleges and
    20  Universities."
    21     Section 5.  The Trustees of the Philadelphia College of
    22  Osteopathic Medicine shall report on forms provided by the
    23  Department of Education to both the chairman and minority
    24  chairman of the Appropriations Committee of the Senate and the
    25  chairman and minority chairman of the Appropriations Committee
    26  of the House of Representatives by September 30, 2004, on how
    27  State-appropriated funds were expended for fiscal year 2003-2004
    28  to reduce the costs to Pennsylvania resident students or to
    29  provide services to Pennsylvania residents.
    30     Section 6.  Any moneys appropriated by this act that are       <--

     1  applied on an individual basis to students, including, but not
     2  limited to student financial assistance, shall be applied in
     3  such a manner that 75% of the appropriated funds are used for
     4  students who are residents of this Commonwealth.
     5     Section 7 6.  This act shall take effect July 1, 2003, or      <--
     6  immediately, whichever is later.
