AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES, JUNE 25, 2003
AN ACT 1 Making appropriations to the Philadelphia Health and Education 2 Corporation for the Colleges of Medicine, Public Health, 3 Nursing and Health Professions and for continuation of 4 pediatric services. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. (a) The sum of $7,329,000 is hereby appropriated 8 to the Philadelphia Health and Education Corporation for the 9 College of Medicine for the fiscal year July 1, 2003, to June 10 30, 2004, for instruction in the Doctor of Medicine program. 11 (b) The sum of $1,623,000 is hereby appropriated to the 12 Philadelphia Health and Education Corporation for the Colleges 13 of Medicine, Public Health, Nursing and Health Professions for 14 the fiscal year July 1, 2003, to June 30, 2004, for the general 15 maintenance of the Colleges of Medicine, Public Health and 16 Nursing, including the Allied Health, Professions and Graduate 17 Schools, and for student aid. 18 (c) The sum of $290,000 is hereby appropriated to the
1 Philadelphia Health and Education Corporation for the fiscal 2 year July 1, 2003, to June 30, 2004, for minority educational 3 and recruitment programs. 4 (d) The sum of $712,000 is hereby appropriated to the 5 Philadelphia Health and Education Corporation, for the fiscal 6 year July 1, 2003, to June 30, 2004, for continued pediatric 7 outpatient and inpatient treatment of severe physically 8 disabling diseases. 9 (e) The sum of $149,000 is hereby appropriated to the 10 Philadelphia Health and Education Corporation, for the fiscal 11 year July 1, 2003, to June 30, 2004, for continued support of 12 the handicapped children's clinic. 13 (f) The sum of $1,900,000 is hereby appropriated to the 14 Philadelphia Health and Education Corporation, for the College 15 of Medicine for the fiscal year July 1, 2003, to June 30, 2004, 16 for operating expenses. 17 (G) AS A CONDITION OF RECEIVING ITS APPROPRIATION UNDER THIS <-- 18 ACT, ON OR AFTER JANUARY 1, 2004, THE MEDICAL SCHOOL SHALL, WHEN 19 ACCEPTING FIRST-YEAR STUDENTS FOR THE NEXT TERM, SET ASIDE 5% OF 20 THE TOTAL NUMBER OF ADMISSIONS FOR STUDENTS WHO AGREE THAT UPON 21 RECEIPT OF THEIR MEDICAL LICENSE, THEY WILL ENGAGE IN THE 22 PRACTICE OF MEDICINE FOR A PERIOD OF FOUR YEARS IN AN AREA 23 WITHIN THIS COMMONWEALTH TERMED AS MEDICALLY UNDERSERVED OR IN A 24 PRIMARY CARE HEALTH PROFESSIONAL SHORTAGE AREA AS REPORTED BY 25 THE DEPARTMENT OF HEALTH. 26 Section 2. (a) Payments to the Philadelphia Health and 27 Education Corporation on account of the appropriations provided 28 in section 1(a), (b), (c) and (f) shall be made quarterly by the 29 Secretary of Education on the basis of costs during the fiscal 30 year and shall be conditioned on continuing authority for 20030H1380B2224 - 2 -
1 inclusion on the Board of Trustees of the Philadelphia Health 2 and Education Corporation of a minimum of five persons who are 3 not elected officials and who are appointed by the Governor, the 4 President pro tempore of the Senate, the Minority Leader of the 5 Senate, the Speaker of the House of Representatives and the 6 Minority Leader of the House of Representatives for terms of 7 office coterminous with that of the respective appointing 8 authority; and shall be further conditioned on these appointees 9 receiving full voting rights as members of the board of 10 trustees. 11 (b) Payments to the Philadelphia Health and Education 12 Corporation on account of the appropriations provided in section 13 1(d) and (e) shall be made by the Secretary of Health in equal 14 quarterly payments. 15 Section 3. (a) The Philadelphia Health and Education 16 Corporation shall provide full, complete and accurate 17 information for the appropriations under section 1(a), (b), (c) 18 and (f) as may be required by the Department of Education or the 19 chairman or the minority chairman of the Appropriations 20 Committee of the Senate or the chairman or the minority chairman 21 of the Appropriations Committee of the House of Representatives. 22 (b) The Philadelphia Health and Education Corporation shall 23 provide full, complete and accurate information for the 24 appropriations under section 1(d) and (e) as may be required by 25 the Department of Health or the chairman or the minority 26 chairman of the Appropriations Committee of the Senate or the 27 chairman or the minority chairman of the Appropriations 28 Committee of the House of Representatives. 29 Section 4. The Philadelphia Health and Education Corporation 30 for the Colleges of Medicine, Public Health, Nursing and Health 20030H1380B2224 - 3 -
1 Professions shall report its revenues and expenditures and
2 present its financial statements in accordance with generally
3 accepted accounting principles and procedures for educational
4 institutions as set forth in the "Higher Education Finance
5 Manual (1975)" and the "Commonwealth of Pennsylvania Budget
6 Instructions for the State System of Higher Education, State-
7 Related Universities and Non-State-Related Colleges and
8 Universities."
9 Section 5. The trustees of the Philadelphia Health and
10 Education Corporation for the Colleges of Medicine, Public
11 Health, Nursing and Health Professions shall report on forms
12 provided by the Department of Education to both the chairman and
13 minority chairman of the Appropriations Committee of the Senate
14 and the chairman and minority chairman of the Appropriations
15 Committee of the House of Representatives by September 30, 2004,
16 on how State-appropriated funds were expended for fiscal year
17 2003-2004 to reduce the costs to Pennsylvania resident students
18 or to provide services to Pennsylvania residents.
19 SECTION 6. ANY MONEYS APPROPRIATED BY THIS ACT THAT ARE <--
20 APPLIED ON AN INDIVIDUAL BASIS TO STUDENTS, INCLUDING, BUT NOT
21 LIMITED TO STUDENT FINANCIAL ASSISTANCE, SHALL BE APPLIED IN
22 SUCH A MANNER THAT 75% OF THE APPROPRIATED FUNDS ARE USED FOR
23 STUDENTS WHO ARE RESIDENTS OF THIS COMMONWEALTH.
24 Section 6 7. This act shall take effect July 1, 2003, or <--
25 immediately, whichever is later.
