           SAYLOR, SEMMEL, STABACK, TIGUE AND YOUNGBLOOD, APRIL 29, 2003

                                     AN ACT

     1  Amending the act of June 24, 1931 (P.L.1206, No.331), entitled
     2     "An act concerning townships of the first class; amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," further providing for personnel of shade tree
     5     commission, their appointment, terms and vacancies.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 3021 of the act of June 24, 1931
     9  (P.L.1206, No.331), known as The First Class Township Code,
    10  reenacted and amended May 27, 1949 (P.L.1955, No.569), is
    11  amended to read:
    12     Section 3021.  Personnel of Commission; Appointment; Terms;
    13  Vacancies.--[The] Except as otherwise provided in this section,
    14  the commission shall be composed of three residents of the
    15  township who shall be appointed by the township commissioners
    16  and shall serve without compensation.
    17     The township commissioners may, by ordinance, provide that
    18  the commission be composed of five members who shall be
    19  residents of the township, shall be appointed by the township

     1  commissioners and shall serve without compensation.
     2     Whenever a shade tree commission of three members is
     3  established by any township, the township commissioners shall
     4  appoint--one member for a term of three years, one for a term of
     5  four years, and one for a term of five years.
     6     Whenever a shade tree commission of five members is
     7  established by any township, the township commissioners shall
     8  appoint members to staggered terms so that one term expires
     9  every year.
    10     On the expiration of the term of any shade tree commissioner,
    11  a successor shall be appointed by the township commissioners, to
    12  serve for a term of five years.
    13     Vacancies in the office of shade tree commissioner shall be
    14  filled by the township commissioners for the unexpired term.
    15     Section 2.  This act shall take effect in 60 days.
