        SENATOR THOMPSON, APPROPRIATIONS, IN SENATE, RE-REPORTED AS
           AMENDED, JUNE 23, 2003

                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, providing for the COMPOSITION AND       <--
     3     expiration of the Pennsylvania Veterans' Memorial Commission
     4     and for the administration of the Pennsylvania Veterans'
     5     Memorial Trust Fund.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Title 51 of the Pennsylvania Consolidated
     9  Statutes is amended by adding a section to read:
    10  § 710.  Pennsylvania Veterans' Memorial Trust Fund.
    11     (a)  Administration.--The separate fund in the State Treasury
    12  known as the Pennsylvania Veterans' Memorial Trust Fund shall be

     1  administered by the State Veterans' Commission, and all moneys
     2  in the fund are appropriated to the State Veterans' Commission
     3  on a continuing basis.
     4     (b)  Purpose.--The moneys in the fund shall be used for the
     5  selection, design, construction, operation and maintenance of an  <--
     6  appropriate physical monument OPERATION AND MAINTENANCE OF THE    <--
     7  PENNSYLVANIA VETERANS' MEMORIAL on the grounds of the Indiantown
     8  Gap National Cemetery and other costs incidental thereto AS       <--
     9  APPROVED BY THE DEPARTMENT. MONEYS IN THE FUND MAY BE USED TO
    10  PAY ANY CONSTRUCTION COSTS WHICH HAVE NOT BEEN PAID ON THE
    11  EFFECTIVE DATE OF THIS SECTION.
    12     (c)  Contributions and solicitation of funds.--
    13         (1)  The State Veterans' Commission is authorized:
    14             (i)  To accept, on behalf of the Commonwealth, gifts,
    15         donations, legacies and usages of money from individuals,
    16         organizations, public or private corporations and other
    17         similar entities.
    18             (ii)  To solicit and raise moneys from public and
    19         private sources.
    20         (2)  All money received or raised under this subsection
    21     shall be paid into the State Treasury and credited to the
    22     fund.
    23     SECTION 2.  SECTION 1903(B) OF TITLE 51 IS AMENDED TO READ:    <--
    24  § 1903.  PENNSYLVANIA VETERANS' MEMORIAL COMMISSION.

    26     (B)  COMPOSITION OF COMMISSION.--THE COMMISSION SHALL BE
    27  COMPOSED OF THE FOLLOWING:
    28         (1)  TWO MEMBERS OF THE SENATE TO BE APPOINTED BY THE
    29     PRESIDENT PRO TEMPORE OF THE SENATE, ONE FROM THE MAJORITY
    30     PARTY AND ONE FROM THE MINORITY PARTY OR THEIR DESIGNEES.

     1     PREFERENCE SHALL BE GIVEN TO HONORABLY DISCHARGED VETERANS.
     2         (2)  TWO MEMBERS OF THE HOUSE OF REPRESENTATIVES TO BE
     3     APPOINTED BY THE SPEAKER OF THE HOUSE OF REPRESENTATIVES, ONE
     4     FROM THE MAJORITY PARTY AND ONE FROM THE MINORITY PARTY OR
     5     THEIR DESIGNEES. PREFERENCE SHALL BE GIVEN TO HONORABLY
     6     DISCHARGED VETERANS.
     7         (3)  THE SECRETARY OF GENERAL SERVICES, OR A DESIGNEE.
     8         (4)  THE EXECUTIVE DIRECTOR OF THE PENNSYLVANIA
     9     HISTORICAL AND MUSEUM COMMISSION, OR A DESIGNEE.
    10         (5)  ONE MEMBER, APPOINTED BY THE GOVERNOR, WHO MUST BE
    11     AN ARCHITECT.
    12         (6)  FIVE MEMBERS, APPOINTED BY THE GOVERNOR, WHO MUST BE
    13     PENNSYLVANIA VETERANS. AT LEAST ONE OF THESE MEMBERS MUST BE
    14     A WOMAN.
    15         (7)  THE COMMANDER OF THE PENNSYLVANIA WAR VETERAN'S
    16     COUNCIL, OR A DESIGNEE.
    17         (8)  THE STATE ADJUTANT OF THE PENNSYLVANIA VETERANS OF
    18     FOREIGN WARS, OR A DESIGNEE.
    19         (9)  THE PENNSYLVANIA STATE COMMANDER OF THE DISABLED
    20     AMERICAN VETERANS, OR A DESIGNEE.
    21         (10)  THE STATE ADJUTANT OF THE PENNSYLVANIA AMERICAN
    22     LEGION, OR A DESIGNEE.
    23         (11)  THE ADJUTANT GENERAL OF THE DEPARTMENT OF MILITARY
    24     AFFAIRS, OR A DESIGNEE.
    25         (12)  THE DIRECTOR OF THE BUREAU OF VETERANS AFFAIRS IN
    26     THE DEPARTMENT OF MILITARY AFFAIRS.
    27         (13)  ONE MEMBER, APPOINTED BY THE GOVERNOR, WHO MUST BE
    28     A CERTIFIED PUBLIC ACCOUNTANT.

    30     Section 2 3.  Section 1906 of Title 51 is amended to read:     <--

     1  § 1906.  Expiration [of chapter].                                 <--
     2     [This] SECTIONS 1901, 1902, 1903 AND 1904 OF THIS chapter      <--
     3  shall expire June 30, [2003] 2005.
     4     Section 3 4.  This act shall take effect as follows:           <--
     5         (1)  The addition of 51 Pa.C.S § 710 shall take effect
     6     June 30, 2005.
     7         (2)  The remainder of this act shall take effect
     8     immediately.
