                                     AN ACT

     1  Amending Title 53 (Municipalities Generally) of the Pennsylvania
     2     Consolidated Statutes, limiting the authority of
     3     municipalities to regulate political signs.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Chapter 13 of Title 53 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subchapter to read:
     8                            SUBCHAPTER E
     9                   REGULATIONS OF POLITICAL SIGNS
    10  Sec.
    11  1371.  Definitions.
    12  1372.  Bonds.
    13  1373.  Candidate signs.
    14  1374.  Referendum signs.
    15  1375.  Limitation.
    16  § 1371.  Definitions.
    17     The following words and phrases when used in this subchapter
    18  shall have the meanings given to them in this section unless the

     1  context clearly indicates otherwise:
     2     "Municipality."  A county, city, borough, incorporated town
     3  or township.
     4  § 1372.  Bonds.
     5     No municipality shall have the authority to require the
     6  posting of a bond or other financial security as a precondition
     7  for erecting or posting signs on private property seeking to
     8  influence the outcome of an election.
     9  § 1373.  Candidate signs.
    10     No municipality may require the removal from private property
    11  of signs seeking to influence the outcome of an election prior
    12  to the day after the general, municipal or special election
    13  sought to be influenced.
    14  § 1374.  Referendum signs.
    15     No municipality may require the removal from private property
    16  of signs seeking to influence the outcome of a referendum prior
    17  to the day after the primary, general, municipal or special
    18  election at which the referendum question is presented to the
    19  electorate.
    20  § 1375.  Limitation.
    21     Nothing contained in this subchapter shall limit the right of
    22  a municipality to impose reasonable regulations on the size or
    23  illumination of signs or to require the removal of signs from
    24  locations in which they create an obstruction to traffic.
    25     Section 2.   This act shall take effect in 60 days.
