        AS REPORTED FROM COMMITTEE ON JUDICIARY, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 23, 2003

                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, further providing for tattooing; and
     3     prohibiting certain body piercing.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 6311 of Title 18 of the Pennsylvania
     7  Consolidated Statutes is amended to read:
     8  § 6311.  Tattooing and body piercing.
     9     (a)  Tattooing.--A person [is guilty of a misdemeanor of the
    10  third degree] commits an offense if he tattoos any person under
    11  the age of 18 years without the expressed [consent of the]        <--
    12  parent or guardian of such person[.] GIVING CONSENT FOR THE       <--
    13  TATTOOING OF THE PERSON AND BEING PRESENT AT THE TIME OF THE
    14  TATTOOING OF THE PERSON.
    15     (b)  Body piercing.--A person commits an offense if he
    16  punctures a part of the body of any person under the age of 18

     1  years with the intent to create a permanent hole for cosmetic
     2  purposes without the expressed consent of the parent or guardian  <--
     3  of such person GIVING CONSENT FOR THE PIERCING OF THE PERSON AND  <--
     4  BEING PRESENT AT THE TIME OF THE PIERCING OF THE PERSON.
     5     (c)  Grading.--A person who commits an offense under this
     6  section shall be guilty of a misdemeanor of the third degree for
     7  the first offense. A person who commits a second or subsequent
     8  offense under this section within one year of the preceding
     9  offense commits a misdemeanor of the second degree.
    10     Section 2.  This act shall take effect in 60 days.
