                                     AN ACT

     1  Amending the act of July 2, 1984 (P.L.561, No.112), entitled "An
     2     act establishing the Pennsylvania Conservation Corps; and
     3     making an appropriation," further providing for supervisors.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 8 of the act of July 2, 1984 (P.L.561,
     7  No.112), known as the Pennsylvania Conservation Corps Act,
     8  amended June 25, 1997 (P.L.339, No.38), is amended to read:
     9  Section 8.  Supervisors.
    10     (a)  Funding.--Funds available for this program may be
    11  expended to pay the wages of crewleaders who shall supervise
    12  corpsmembers as prescribed by the department.
    13     (b)  Crewleader criteria.--Persons eligible to be hired as
    14  crewleaders by the department shall be men and women who are:
    15         (1)  Domiciled in the Commonwealth for at least six

     1     months prior to employment in the programs.
     2         (2)  Registered with the local Job Center for employment.
     3         (3)  Physically and mentally capable of performing labor
     4     intensive work and supervisory duties.
     5         (4)  Not attending a postsecondary institution full time
     6     and who provide assurance that they did not leave school for
     7     the purpose of employment as a supervisor in the program.
     8     (c)  Term of employment.--A crewleader shall be employed by
     9  the department for a period of one year. At the option of the
    10  department, a crewleader who has successfully completed a one-
    11  year term of service may be extended for subsequent one-year
    12  terms.
    13     (d)  Hourly wage.--Crewleaders shall receive an hourly wage
    14  that exceeds the hourly wage of corpsmembers by a minimum of
    15  $5.00.
    16     (e)  Benefits.--
    17         (1)  Crewleaders shall not be entitled to any employee
    18     benefits provided to existing employees of the department or
    19     of other State agencies [or local agencies] except for paid
    20     Commonwealth holidays [and], workmen's compensation coverage
    21     and health and dental benefits equivalent to the benefits
    22     received by other full-time departmental employees, which
    23     shall be provided through the funds appropriated to carry out
    24     this act.
    25         (2)  A crewleader who has served for one year shall be
    26     entitled to five paid vacation days and five days of paid
    27     sick leave during each subsequent year of service.
    28         (3)  Service as a crewleader, before or after the
    29     effective date of this paragraph, shall be considered as
    30     State service under 24 Pa.C.S. Pt. IV (relating to retirement

     1     for school employees) and 71 Pa.C.S. Pt. XXV (relating to
     2     retirement for State employees and officers) for the purposes
     3     of calculating pension benefits in any future State
     4     employment.
     5     (f)  Veterans' preference.--In the hiring of crewleaders,
     6  preference shall be given to honorably discharged veterans of
     7  the armed forces of the United States.
     8     Section 2.  This act shall take effect in 60 days.
