AN ACT 1 To provide from the General Fund for the expenses of the 2 Executive, Legislative and Judicial Departments of the 3 Commonwealth, the public debt and for the public schools for 4 the fiscal year July 1, 2003, to June 30, 2004, for certain 5 institutions and organizations, and for the payment of bills 6 incurred and remaining unpaid at the close of the fiscal year 7 ending June 30, 2003; to provide appropriations from the 8 State Lottery Fund, the Energy Conservation and Assistance 9 Fund, the Hazardous Material Response Fund, The State Stores 10 Fund, the Milk Marketing Fund, the Home Investment Trust 11 Fund, the Emergency Medical Services Operating Fund, the 12 Tuition Payment Fund, the Banking Department Fund, the 13 Firearm Records Check Fund, the Ben Franklin Technology 14 Development Authority Fund and the Tobacco Settlement Fund to 15 the Executive Department; to provide appropriations from the 16 Judicial Computer System Augmentation Account to the Judicial 17 Department for the fiscal year July 1, 2003, to June 30, 18 2004; to provide appropriations from the Motor License Fund 19 for the fiscal year July 1, 2003, to June 30, 2004, for the 20 proper operation of the several departments of the 21 Commonwealth and the Pennsylvania State Police authorized to 22 spend Motor License Fund moneys; to provide for the 23 appropriation of Federal funds to the Executive Department of 24 the Commonwealth and for the establishment of restricted 25 receipt accounts for the fiscal year July 1, 2003, to June 26 30, 2004, and for the payment of bills remaining unpaid at 27 the close of the fiscal year ending June 30, 2003. 28 TABLE OF CONTENTS 29 PART I. Effective date. 10 The General Assembly of the Commonwealth of Pennsylvania 11 hereby enacts as follows: 12 PART I 13 GENERAL PROVISIONS 14 Section 101. Short title.--This act shall be known and may 15 be cited as the General Appropriation Act of 2003. 16 Section 102. Definitions.--The following words and phrases 17 when used in this act shall have the meanings given to them in 18 this section unless the context clearly indicates otherwise: 19 "Employees." Includes all directors, superintendents, bureau 20 or division chiefs, assistant directors, assistant 21 superintendents, assistant chiefs, experts, scientists, 22 engineers, surveyors, draftsmen, accountants, secretaries, 23 auditors, inspectors, examiners, analysts, statisticians, 24 marshals, clerks, stenographers, bookkeepers, messengers and 25 other assistants in any department, board or commission. 26 "Expenses" and "maintenance." Includes all printing, binding 27 and stationery, food and forage, materials and supplies, 28 traveling expenses, training, motor vehicle supplies and 29 repairs, freight, express and cartage, postage, telephones and 30 telegraph rentals and toll charges, newspaper advertising and 20030H0648B0730 - 7 -
1 notices, public advertising by or through any medium, fuel, 2 light, heat, power and water, minor construction and renovation, 3 repairs or reconstruction of equipment, buildings and 4 facilities, rent of real estate and equipment, premiums on 5 workers' compensation, insurance premiums on policies of 6 liability insurance, insurance premiums on medical payment 7 insurance and surety bonds for volunteer workers, premiums on 8 employee group life insurance and employee and retired employee 9 group hospital and medical insurance, payment of Commonwealth 10 share of Social Security taxes and unemployment compensation 11 costs for State employees, the purchase of replacement or 12 additional equipment and machinery and all other incidental 13 costs and expenses, including payment to the Department of 14 General Services of mileage and other charges for the use of 15 automobiles and rental payments for permanently assigned 16 automobiles and of expenses or costs of services incurred 17 through the Purchasing Fund. The term "expenses" also shall 18 include the medical costs for the treatment of inmates of State 19 institutions when the inmate must be transferred to an outside 20 hospital: Provided, That in no case shall the State institution 21 pay more for patient care than that provided under the State 22 medical assistance program. 23 Section 103. Abbreviations.--The following abbreviations 24 when used in this act shall have the meanings given to them in 25 this section unless the context clearly indicates otherwise: 26 "ARC." State appropriations.--(a) General Fund.--The 26 following sums set forth in this act, or as much thereof as may 27 be necessary, are hereby specifically appropriated from the 28 General Fund to the several hereinafter named agencies of the 29 Executive, Legislative and Judicial Departments of the 30 Commonwealth for the payment of salaries, wages or other 20030H0648B0730 - 9 -
1 compensation and travel expenses of the duly elected or 2 appointed officers and employees of the Commonwealth, for the 3 payment of fees for contractual services rendered, for the 4 purchase or rental of goods and services, printing, public 5 advertising by or through any medium, equipment, land and 6 buildings and for payment of any other expenses, as provided by 7 law or by this act, necessary for the proper conduct of the 8 duties, functions and activities and for the purposes 9 hereinafter set forth for the fiscal year beginning July 1, 10 2003, and for the payment of bills incurred and remaining unpaid 11 at the close of the fiscal year ending June 30, 2003. 12 (b) State Lottery Fund.--The following sums set forth in 13 this act, or as much thereof as may be necessary, are hereby 14 specifically appropriated from the State Lottery Fund to the 15 several hereinafter named agencies of the Executive Department 16 of the Commonwealth for the payment of salaries, wages or other 17 compensation and travel expenses of the duly appointed officers 18 and employees of the Commonwealth, for the payment of fees for 19 contractual services rendered, for the purchase or rental of 20 goods and services and for payment of any other expenses, as 21 provided by law or by this act, necessary for the proper conduct 22 of the duties, functions and activities and for the purposes 23 hereinafter set forth for the fiscal year beginning July 1, 24 2003, and for the payment of bills incurred and remaining unpaid 25 at the close of the fiscal year ending June 30, 2003. 26 (c) Energy Conservation and Assistance Fund.--The following 27 sums set forth in this act, or as much thereof as may be 28 necessary, are hereby specifically appropriated from the Energy 29 Conservation and Assistance Fund to the several hereinafter 30 named agencies of the Executive Department of the Commonwealth 20030H0648B0730 - 10 -
1 for the payment of fees for contractual services rendered, for 2 the purchase or rental of goods and services and for the payment 3 of any other expenses, as provided by law or by this act, 4 necessary for the proper conduct of the duties, functions and 5 activities and for the purposes hereinafter set forth for the 6 fiscal year beginning July 1, 2003, and for the payment of bills 7 incurred and remaining unpaid at the close of the fiscal year 8 ending June 30, 2003. 9 (d) Judicial Computer System Augmentation Account.--The 10 following sums set forth in this act, or as much thereof as may 11 be necessary, are hereby specifically appropriated from the 12 restricted receipt account established within the General Fund, 13 known as the Judicial Computer System Augmentation Account, to 14 the Judicial Department of the Commonwealth for the payment of 15 salaries, wages or other compensation and travel expenses, for 16 the payment of fees for contractual services rendered, for the 17 purchase or rental of goods and services and for the payment of 18 any other expenses, as provided by law or by this act, necessary 19 for the proper conduct of the duties, functions and activities 20 and for the purposes hereinafter set forth for the fiscal year 21 beginning July 1, 2003, and for the payment of bills incurred 22 and remaining unpaid at the close of the fiscal year ending June 23 30, 2003. 24 (e) Emergency Medical Services Operating Fund.--The 25 following sums set forth in this act, or as much thereof as may 26 be necessary, are hereby specifically appropriated from the 27 Emergency Medical Services Operating Fund to the several 28 hereinafter named agencies of the Executive Department of the 29 Commonwealth for the payment of fees for contractual services 30 rendered, for the purchase or rental of goods and services and 20030H0648B0730 - 11 -
1 for the payment of any other expenses, as provided by law or by 2 this act, necessary for the proper conduct of the duties, 3 functions and activities and for the purposes hereinafter set 4 forth for the fiscal year beginning July 1, 2003, and for the 5 payment of bills incurred and remaining unpaid at the close of 6 the fiscal year ending June 30, 2003. 7 (f) The State Stores Fund.--The following sums set forth in 8 this act, or as much thereof as may be necessary, are hereby 9 specifically appropriated from The State Stores Fund to the 10 hereinafter named agency of the Executive Department of the 11 Commonwealth for the payment of salaries, wages or other 12 compensation and travel expenses of the duly appointed officers 13 and employees of the Commonwealth, for the payment of fees for 14 contractual services rendered, for the purchase or rental of 15 goods and services and for the payment of any other expenses, as 16 provided by law or by this act, necessary for the proper conduct 17 of the duties, functions and activities and for the purposes 18 hereinafter set forth for the fiscal year beginning July 1, 19 2003, and for the payment of bills incurred and remaining unpaid 20 at the close of the fiscal year ending June 30, 2003. 21 (g) Motor License Fund.--The following sums, or as much 22 thereof as may be necessary, are hereby appropriated from the 23 Motor License Fund to the hereinafter named agencies of the 24 Executive Department for the payment of salaries, wages and 25 other compensation and travel expenses of the duly elected or 26 appointed officers and employees of the Commonwealth, for 27 contractual services and other expenses necessary for the proper 28 conduct of the duties, functions and activities for the purposes 29 hereinafter set forth for the fiscal year beginning July 1, 30 2003, and for the payment of bills incurred and remaining unpaid 20030H0648B0730 - 12 -
1 at the close of the fiscal year ending June 30, 2003. 2 (h) Aviation Restricted Revenue Account.--The following 3 sums, or as much thereof as may be necessary, are hereby 4 appropriated from the Aviation Restricted Revenue Account in the 5 Motor License Fund to the hereinafter named agencies of the 6 Executive Department for the purposes set forth herein for the 7 fiscal year beginning July 1, 2003, and for the payment of bills 8 incurred and remaining unpaid at the close of the fiscal year 9 ending June 30, 2003. 10 (i) Hazardous Material Response Fund.--The following sums 11 set forth in this act, or as much thereof as may be necessary, 12 are hereby specifically appropriated from the Hazardous Material 13 Response Fund to the several hereinafter named agencies of the 14 Executive Department of the Commonwealth for the payment of fees 15 for contractual services rendered, for the purchase or rental of 16 goods and services and for the payment of any other expenses, as 17 provided by law or by this act, necessary for the proper conduct 18 of the duties, functions and activities and for the purposes 19 hereinafter set forth for the fiscal year beginning July 1, 20 2003, and for the payment of bills incurred and remaining unpaid 21 at the close of the fiscal year ending June 30, 2003. 22 (j) Milk Marketing Fund.--The following sums set forth in 23 this act, or as much thereof as may be necessary, are hereby 24 specifically appropriated from the Milk Marketing Fund to the 25 several hereinafter named agencies of the Executive Department 26 of the Commonwealth for the payment of salaries, wages or other 27 compensation and travel expenses of the duly appointed officers 28 and employees of the Commonwealth, for the payment of fees for 29 contractual services rendered, for the purchase or rental of 30 goods and services and for the payment of any other expenses, as 20030H0648B0730 - 13 -
1 provided by law or by this act, necessary for the proper conduct 2 of the duties, functions and activities and for the purposes 3 hereinafter set forth for the fiscal year beginning July 1, 4 2003, and for the payment of bills incurred and remaining unpaid 5 at the close of the fiscal year ending June 30, 2003. 6 (k) Home Investment Trust Fund.--The following sums set 7 forth in this act, or as much thereof as may be necessary, are 8 hereby specifically appropriated from the Home Investment Trust 9 Fund to the hereinafter named agencies of the Executive 10 Department of the Commonwealth for the payment of salaries, 11 wages or other compensation and travel expenses of the duly 12 appointed officers and employees of the Commonwealth, for the 13 payment of fees for contractual services rendered, for the 14 purchase or rental of goods and services and for the payment of 15 any other expenses, as provided by law or by this act, necessary 16 for the proper conduct of the duties, functions and activities 17 and for the purposes hereinafter set forth for the fiscal year 18 beginning July 1, 2003, and for the payment of bills incurred 19 and remaining unpaid at the close of the fiscal year ending June 20 30, 2003. 21 (l) Tuition Payment Fund.--The following sums set forth in 22 this act, or as much thereof as may be necessary, are hereby 23 specifically appropriated from the Tuition Payment Fund to the 24 hereinafter named agencies of the Executive Department of the 25 Commonwealth for the payment of salaries, wages or other 26 compensation and travel expenses of the duly appointed officers 27 and employees of the Commonwealth, for the payment of fees for 28 contractual services rendered, for the purchase or rental of 29 goods and services and for the payment of any other expenses, as 30 provided by law or by this act, necessary for the proper conduct 20030H0648B0730 - 14 -
1 of the duties, functions and activities and for the purposes 2 hereinafter set forth for the fiscal year beginning July 1, 3 2003, and for the payment of bills incurred and remaining unpaid 4 at the close of the fiscal year ending June 30, 2003. 5 (m) Banking Department Fund.--The following sums set forth 6 in this act, or as much thereof as may be necessary, are hereby 7 specifically appropriated from the Banking Department Fund to 8 the hereinafter named agencies of the Executive Department of 9 the Commonwealth for the payment of salaries, wages or other 10 compensation and travel expenses of the duly appointed officers 11 and employees of the Commonwealth, for the payment of fees for 12 contractual services rendered, for the purchase or rental of 13 goods and services and for the payment of any other expenses, as 14 provided by law or by this act, necessary for the proper conduct 15 of the duties, functions and activities and for the purposes 16 hereinafter set forth for the fiscal year beginning July 1, 17 2003, and for the payment of bills incurred and remaining unpaid 18 at the close of the fiscal year ending June 30, 2003. 19 (n) Firearm Records Check Fund.--The following sums set 20 forth in this act, or as much thereof as may be necessary, are 21 hereby specifically appropriated from the Firearm Records Check 22 Fund to the hereinafter named agencies of the Executive 23 Department of the Commonwealth for the payment of salaries, 24 wages or other compensation and travel expenses of the duly 25 appointed officers and employees of the Commonwealth, for the 26 payment of fees for contractual services rendered, for the 27 purchase or rental of goods and services and for the payment of 28 any other expenses, as provided by law or by this act, necessary 29 for the proper conduct of the duties, functions and activities 30 and for the purposes hereinafter set forth for the fiscal year 20030H0648B0730 - 15 -

1 the causes of poverty in the community or those areas of the 2 community where poverty is a particularly acute problem. In 3 addition, new focus may be placed on the unemployed, both old 4 and new. Local agencies may lower their eligibility requirements 5 for recipients to three months to allow greater flexibility to 6 assure proper consideration of each recipient. 7 (d) Preventive Health and Health Services Block Grant.--The 8 Preventive Health and Health Services Block Grant (PHHSBG) is 9 for the provision of preventive health and other health services 10 related to emergency medical systems, health initiative grants, 11 comprehensive public health, hypertension, fluoridation, health 12 education, risk reduction, home health, rape crisis and domestic 13 violence services. 14 (e) Maternal and Child Health Services Block Grant.--The 15 Maternal and Child Health Services Block Grant (MCHSBG) is to 16 enable states to maintain and strengthen their leadership in 17 planning, promoting, coordinating and evaluating health care for 18 pregnant women, mothers, infants and children, and children with 19 special health care needs, and in providing health services for 20 mothers and children who do not have access to adequate health 21 care. 22 (f) Low-Income Home Energy Assistance Block Grant.--The Low- 23 Income Home Energy Assistance Block Grant (LIHEABG) is to help 24 lessen the impact of the high cost of energy on low-income 25 families and individuals, including energy efficiency grants for 26 low-income dwellings. No less than 15% of the LIHEABG funds 27 received shall be used for weatherization. LIHEABG funds 28 received pursuant to a Presidential release of contingency funds 29 shall be exempt from the 15% requirement. 1 PART XVIII 2 (RESERVED) 3 PART XIX 4 SPECIAL PROVISIONS FOR FEDERAL FUNDS 5 FOR 2003-2004 6 Section 1901. General Fund repository for Federal funds.-- 7 All moneys received from the Federal Government as contributions 8 or supplements to the departments or agencies of the 9 Commonwealth or the programs herein provided shall be paid into 10 the General Fund. 11 Section 1902. Limitation on encumbering or spending Federal 12 funds.--Federal funds shall be encumbered or spent only to the 13 extent that such funds are estimated as being available during 14 the fiscal year of the Commonwealth. 15 Section 1903. Appropriation of prior unspent Federal 16 funds.--Any Federal money which has been previously appropriated 17 by the General Assembly and authorized or allocated by the 18 Federal Government but remains unspent from prior fiscal years 19 and will not be renewed for fiscal year 2003-2004 is hereby 20 appropriated. 21 Section 1904. Subgrants between Federal fund 22 appropriations.--Subgrants may be made between appropriations 23 without further approval of the General Assembly. The Secretary 24 of the Budget shall submit a list of subgrants to the chairman 25 and minority chairman of the Appropriations Committee of the 26 Senate and the chairman and minority chairman of the 27 Appropriations Committee of the House of Representatives 28 quarterly. No subgrant to a State agency, however, may be made 29 from a restricted receipt account without a specific 30 appropriation by the General Assembly. 20030H0648B0730 - 215 -
1 Section 1905. Utilization of emergency Federal funds.--(a) 2 Federal funds available for costs and damages resulting from 3 natural disasters or civil disobedience may be added to an 4 appropriation contained in this act or to funds appropriated or 5 may be used for the purposes prescribed by the Federal 6 Government. 7 (b) In addition to the moneys appropriated by this act, all 8 moneys received from the Federal Government for the purpose of 9 disaster assistance or relief, or other moneys received as a 10 direct result of terrorist acts and moneys for homeland security 11 and defense, shall be paid into the General Fund and are hereby 12 appropriated out of the General Fund to the departments, boards, 13 commissions or agencies designated by the Governor. 14 (c) In the event of any emergency situation in which the 15 General Assembly cannot act in sufficient time, the Governor is 16 authorized through executive authorization to provide up to 17 $10,000,000 in Federal funds to alleviate the emergency 18 situation. For the purposes of this section, "emergency" is 19 defined as any situation in which there is a chance of or which 20 may result in substantial human suffering. 21 Section 1906. Transfer of funds from TANFBG to CCDFBG and 22 SSBG.--In accordance with Federal law which permits the transfer 23 of funds from the TANFBG to the CCDFBG and SSBG, the Department 24 of Public Welfare, upon approval of the Secretary of the Budget, 25 may make such transfers of funds provided that any such transfer 26 will not result in a deficit in any appropriation from which 27 funds are transferred. The Secretary of the Budget shall provide 28 ten days prior notification of any such transfers to the 29 chairman and the minority chairman of the Appropriations 30 Committee of the Senate and the chairman and minority chairman 20030H0648B0730 - 216 -
1 of the Appropriations Committee of the House of Representatives. 2 Section 1907. Transfer of LIHEAP funds.--(a) The Department 3 of Public Welfare, upon approval of the Secretary of the Budget, 4 may transfer up to 15% of any additional funds received for the 5 LIHEAP program either through an increase in the regular program 6 or a Presidential release of contingency funds, to the 7 Department of Community and Economic Development for the LIHEAP 8 - Weatherization Program. The Secretary of the Budget shall 9 provide ten days prior notification of any such transfers to the 10 chairman and minority chairman of the Appropriations Committee 11 of the Senate and the chairman and minority chairman of the 12 Appropriations Committee of the House of Representatives. 13 (b) The Department of Public Welfare, upon approval of the 14 Secretary of the Budget, may transfer LIHEAP administrative 15 funds to the Department of Community and Economic Development 16 subject to any limitations under Federal law. The Secretary of 17 the Budget shall provide ten days prior notification of any such 18 transfer to the chairman and minority chairman of the 19 Appropriations Committee of the Senate and the chairman and 20 minority chairman of the Appropriations Committee of the House 21 of Representatives. 22 PART XX 23 MISCELLANEOUS PROVISIONS FOR 2003-2004 24 Section 2001. Prior laws unaffected.--Except as provided in 25 section 253, this act is not intended to be inconsistent with or 26 to repeal any provision of any act enacted at this or any prior 27 session of the General Assembly regulating the purchase of 28 supplies, the ordering of printing and binding, the purchase, 29 maintenance and use of automobiles, the method of making 30 payments from the State Treasury for any purpose or the 20030H0648B0730 - 217 -
1 functioning of any administrative department, board or 2 commission. 3 Section 2002. Compliance with other law before funds 4 available.--No appropriation made by this act to any department, 5 board, commission or agency of the Executive Department shall be 6 available unless and until the department, board, commission or 7 agency has complied with sections 615 and 616 of the act of 8 April 9, 1929 (P.L.177, No.175), known as The Administrative 9 Code of 1929. 10 Section 2003. Contracts prerequisite to encumbering or 11 committing funds.--Funds available to agencies, boards, 12 departments, commissions, or other governmental entities under 13 this act for the procurement of supplies, services or 14 construction shall not be available for payment of, or to be 15 committed to or encumbered for payment of, any such procurement 16 unless and until the agency, board, department or other 17 governmental entity has complied with all of the requirements 18 applicable to the procurement that are set out in 62 Pa.C.S. 19 (relating to procurement) and in the policies, procedures and 20 regulations instituted in accordance with that code. 21 Section 2004. Minority business set-asides.--(a) Each 22 department or other instrumentality of the Commonwealth listed 23 in Subpart A of Part II authorized to contract for buildings, 24 highways, commodities, equipment, supplies or services shall 25 report to the General Assembly all information pertinent to 26 anticipated procurement needs at the beginning of each fiscal 27 year and each fiscal quarter thereafter. 28 (b) As used in this section, the term "minority business" 29 means a minority business enterprise as defined in the act of 30 July 22, 1974 (P.L.598, No.206), known as the Pennsylvania 20030H0648B0730 - 218 -
1 Minority Business Development Authority Act. 2 Section 2005. Appropriation of funds from miscellaneous 3 sources.--(a) In addition to the amounts appropriated by this 4 act, moneys received in payment for food and household supplies 5 furnished to employees and other persons, except inmates, by an 6 institution, and moneys received from the proceeds from the sale 7 of any products of the soil, meats, livestock, timber or other 8 materials sold by the department shall be paid into the General 9 Fund and are hereby appropriated out of the General Fund to the 10 several respective institutions for the operation and 11 maintenance of the institutions. 12 (b) In addition to the amounts appropriated by this act, all 13 moneys received from any other source, except the Federal 14 Government, as contributions for the programs provided herein or 15 as payment for services or materials furnished by one 16 institution to another, except those collections designated as 17 revenues, shall be paid into the General Fund and are hereby 18 appropriated out of the General Fund for the purposes of the 19 respective appropriations. 20 (c) In addition to any funds specifically appropriated by 21 this act, all moneys received by a department or agency of the 22 Commonwealth from any other sources, except the Federal 23 Government, as contributions or supplements to the department or 24 agency for a program or administration of an act included in 25 this act shall be paid into the General Fund and credited to the 26 appropriation for that program or administration of the act. 27 Section 2006. Lapsing of unused funds.--(a) Except as 28 otherwise provided by law or by this section, that part of all 29 appropriations in Parts II, III, IV, V, VI, VII, VIII, IX, X, 30 XI, XII, XIII, XIV, XV and XVI unexpended, uncommitted or 20030H0648B0730 - 219 -
1 unencumbered as of June 30, 2004, shall automatically lapse as 2 of that date. 3 (b) The appropriation in section 213 for an agricultural 4 consumptive water study shall lapse on June 30, 2005. 5 (c) The appropriations in Part II to the Legislative 6 Department shall be continuing appropriations. 7 Section 2007. Appellate courts appropriation contingency.-- 8 The funds appropriated in Part II to the Supreme, Superior and 9 Commonwealth Courts for justice and judge expenses are 10 contingent upon a vouchered expense account plan being continued 11 by the Supreme Court. 12 Section 2008. Transfer of excess funds.--The Governor may 13 transfer any excess money in those funds receiving proceeds of 14 Commonwealth of Pennsylvania general obligation bonds in excess 15 of the amount necessary for the purposes for which the bonds 16 were issued to the appropriate sinking fund for payment of debt 17 service due on outstanding bonds. If such excess funds, together 18 with any available balance, exceed the amount of debt service 19 remaining to be paid, the funds shall be transferred to the 20 General Fund or to the appropriate special fund responsible for 21 such debt service. 22 Section 2009. Transfer of funds by the Supreme Court.--(a) 23 The Supreme Court may transfer any excess funds appropriated in 24 sections 281, 285, 286, 287 and 291 to the Judicial Department 25 in Part II to the Judicial Computer Augmentation Account during 26 the month of June 2004. No transfer may create or increase a 27 deficiency in the appropriation from which the transfer is made. 28 Whenever the Supreme Court makes a transfer under this 29 subsection, the Supreme Court shall give written notification to 30 the Secretary of the Budget and chairman and minority chairman 20030H0648B0730 - 220 -
1 of the Senate Committee on Appropriations and the chairman and 2 the minority chairman of the House of Representatives Committee 3 on Appropriations ten days prior to any transfer which shall 4 also include certification that such transfer will not result in 5 a deficit in any appropriation. 6 (b) The Supreme Court may transfer funds appropriated in 7 section 281 between the line items in that section provided that 8 no transfer may create or increase a deficiency in the 9 appropriation from which the transfer is made. Whenever the 10 Supreme Court makes a transfer under this subsection, the 11 Supreme Court shall give written notification to the Secretary 12 of the Budget and the chairman and minority chairman of the 13 Senate Committee on Appropriations and the chairman and the 14 minority chairman of the House of Representatives Committee on 15 Appropriations ten days prior to any transfer which shall also 16 include certification that such transfer will not result in a 17 deficit in any appropriation. 18 PART XXI 19 EFFECTIVE DATE 20 Section 2101. Effective date.--This act shall take effect as 21 follows: 22 (1) Part XVIII shall take effect immediately. 23 (2) This section shall take effect immediately. 24 (3) The remainder of this act shall take effect July 1, 25 2003, or immediately, whichever is later.
