AN ACT
1 Amending the act of May 29, 1956 (1955 P.L.1804, No.600),
2 entitled, as amended, "An act providing for the establishment
3 of police pension funds or pension annuities in certain
4 boroughs, towns and townships; authorizing the establishment
5 of police pension funds or pension annuities by regional
6 police departments; providing for the regulation and
7 maintenance of police pension funds or pension annuities;
8 providing for an actuary; continuance of existing funds or
9 transfer thereof to funds herein established; prescribing
10 rights of beneficiaries; contributions by members; providing
11 for expenses of administration; continuation of existing
12 authority to provide annuity contracts; credit for military
13 service; refunds; exempting allowances from judicial process;
14 and repealing certain acts," providing for part-time service
15 credit.
16 The General Assembly of the Commonwealth of Pennsylvania
17 hereby enacts as follows:
18 Section 1. The act of May 29, 1956 (1955 P.L.1804, No.600),
19 referred to as the Municipal Police Pension Law, is amended by
20 adding a section to read:
21 Section 4.1. (a) Any member of the police force employed by
1 a borough, town, township or regional police department, who has 2 been a regularly appointed full-time employe of any such 3 political subdivision or regional police department for a period 4 of at least six months and who prior thereto was a member of 5 such force on a part-time basis, shall have credited to his 6 employment record for pension or retirement benefits all of the 7 time spent by him in such part-time service. 8 (b) The ordinance or resolution establishing the police 9 pension fund may provide full service credit for each year of 10 part-time service or fraction thereof, not to exceed five years, 11 to any member of the police force who was employed by the 12 political subdivision or regional police department during such 13 part-time service. The amount due for the purchase of credit for 14 such part-time service shall be computed by applying the average 15 normal cost rate for borough, town, township and regional police 16 pension plans as certified by the Public Employee Retirement 17 Commission, but not to exceed ten per centum, to the member's 18 average annual rate of compensation over the first three years 19 of municipal service and multiplying the result by the number of 20 years and fractional part of a year of creditable part-time 21 service being purchased together with interest at the rate of 22 four and three-quarters per centum compounded annually from the 23 date of initial entry into full-time municipal service to the 24 date of payment. 25 (c) Any member of the police force shall be eligible to 26 receive service credit for part-time service as provided in 27 subsections (a) and (b) provided that he is not entitled to 28 receive, eligible to receive now or in the future or is 29 receiving retirement benefits for such service under a 30 retirement system administered and wholly or partially paid for 20030H0484B0562 - 2 -

2 Section 2. This act shall take effect in 60 days.
